District Attorney George Neuner is now preparing his brief to be sub' 'mitted to the supreme court in the case of Douglas county vs. the South ern Oregon j Company and others, The case is Bomcwhat similar to the case of the O. & C. grunt which Is now being settled in congress. It was first brought up in the cir cuit court when the county filed suit to foreclose tax liens held by the county against the Southern Oregon Compuny and the" settlers on the land originally Included In the Coos Ray wagon road grant. It is claim ed that the taxes became delinquent the year 11)09, and that certifi cates of delinquency -were Issued and that as taxes were still due and unpaid, the lands should be sold by the shoiiff. An answor was filed to the com plaint holding that the land had first been given to the state for the purposo of building a wagon road to the navignblo waters of Coos bay from Roseburg, and that the South ern Oregon Company had obtained title to this property. In a recent decision of the district court of the united States in deciding on a suit brought by the attorney general it was held that the company held titlo only to tho amount of $2.50 per ficro and that all of thu remaining interest in said lands and ail of them over and above the umount of $2.50 per acre remained In the naino of the United States of America or be came subject to taxation by the state of Oregon. Therefore tho defendant claimed that It vas judicially determ ined that it "had no interest greater than $2.50 per acre In the land and that $2.50 was the limit of vf.ne beyond which the assessor of Doug las county could not go in his assess ing of the property. District Attorney Neuner then filed a demurrer on tho part of the! county, his reaso being "that the. further und separate answer nnd tlo fense and the whole theeof. that such now nmttor therein contained does not constltuto a defense to the application for decree foreclosing the tax Hens of Douglas county, Oregon, the plaintiff therein." This domurrer was sustained by Judge Hamilton In u decision given December 3, 1915. On February 14, -191t, tho cause nnd proceedings again camo on for trial before his honor Judge J. W. Hamilton, upon the pleadings and evidence submitted by the respec tive parties. It was agreed by the counsel that the certificates of de linquency mentioned and described In the pleadings are In statutory form and were filed as aliened In the bill of complaint and tho only oh- Jectlon niado thereto by the defend ant, the Southern Oregon Company was the objection specifically alleg ed in tho answer In effect that the decision of the district court of thej ! United Stntes for the district of Oro- gon enjoined tho Southorn Oregon Company from selling or disposing of ! any of this land and decreed that : the only Interest the Southern Ore i gon Company had In this land was an Interest to tho extent of two and one-half dollars per 'acre, and there for the assessment was a void assess ; incut. It was also admitted by Dis trict Attorney Neuner that the nssos- l sor lunl assessed tho laud at Tls ; true cash value .assessing the full ! title against the Southern Oregon Company in tho same manner and to the same extent that the other prop erty bad been assessed. On the Hth day of February I Judge Hamilton filed his Judgment 1 and decree, based on the findings of ; facta and conclusions of the law. awarding the plaintiff, Douglas coun ty, judgment and decree against the Southern Oregon Company and Hiv ing permission to the sheriff to sell the lands named In the complaint for the collection of taxes. AC a meeting of the board of di rectors of the Roseburg Park St Fair Association held this afternoon, an agreement was entered into between the association and Mr. Kendall, by the terms of which the Kendall Lumber Corporation guarantees the fair association that it will con struct and have ready for operation a saw mill that will have a capacity as state above, in accordance with the deed and escrow agreement now in tho First State & Savings Bank, of this city, on or before February 191!), on condition that a railroad is built within that time to furnish transportation for logs to supply the said mill. If "the Kendall Lumber Corporation shall fail to have such . unit completed and In operation, !t shall pay to the fair association the sum of $ 10.000 as liquidated damages. Tnis action on Mr. Ken dall's part shows conclusively his good faith in the matter, and as' sines the citizens of Roseburg that the mill will be built, provided the city or some one else builds the roitd. This plan seems to 'elimin ate all of tho objections which have been raised to tho previous plan and against which the supreme court ruled adversely. Under the propos ed system, the city will be fully pro tected as to ownership, title and power to dispose of Its holdings. The argument previously raised, that al profit from the operation of the road 'would, for the greater part, go to others than the city, is refuted, and the right to fix rates which will In sure a profit over the operating ex penso Is also retained. The city may at any time lease or sell the road, or operate It. munielp ally, retaining such dividends as nifcy be realized from the operation. All things considered, it looks like Rose burg will have a railroud and saw mill after all, and on terms which must havo the approval of all her citizens. Mr. Kendall leaves tonight for hit home at Pittsburg and will remain In the enst until such a time as the election has been held and the mat ter fully decided. He states that he will begin work at once after the money has been voted for the construction of the railroad provided he Is given the contract. Mr. Setec man will still remian In Uosebrug as his private representative. The city council will determine nt its regular meeting Monday night as to the special election.
