SALEM, Or., Aug. 14. Either penltentiury or jail sentences, fines or dismissal from office confront sev eral mayors, police judges and other city officials, as well as county offic ials of Oregon, including sheriffs, and district attorneys, according to an announcement made by Governor West today. Unless these officials mend their ways in numerous localities, he de clares, and stop-winking at violations of law and ignoring their oaths or office, a blow will fall through the enforcing, of a section of the code which so far as is known, has never been exercised In the courts of the state. A quiet investigation carried on for several months through vnricu channels now known only to the gov ernor has piled up In the executive of fices a vast amount of Information, he states, which will be ready for use at the psychological moment. Iiiuv's Provisions Strict. The provisions of the code under which he intends to operate are as follows: "If any officer of this state, or of any county, town, or other municipal or public corporation therein, other than the governor, justices of the supreme court, or members of the legislative assembly, shall wilfully and knowingly charge, take, or re ceive any fee. or compensation, other than that authorized or permitted by law, for any official service or duty performed by such officer, or shall wilfully neglect to perform any duty or service pertaining to his office, with Intent to Injure or defraud any one, or shall wilfully neglect or re fuse to perform such duty or service to the injury of anyone, or the mani fest hindrance of public justice or business, whether such Injury, hin drance, or obstruction was particu larly intended or not, upon convic tion thereof shall be punished by Imprisonment in the penitentiary not less than six months nor more than one year, or by Imprisonment in the! county jail not less than three months nor more than one year or by a fine ot not less than $50 nor more than ? 500 or by dismissal from office, with or without either or any of such punish-! menu." Huntington, Sumpter and Red mond probably will be the first three towns In which the officials will feel the strong hand of the executive un der the newly outlined program. Sheriff Balfour, of Crook county, will be one to fall under the gov ernor's displeasure. This much has been picked up around the execu tive's offices. Some time ago Governor West formally notified Sheriff Balfour of complaints which have frequently come into his office as to affairs at Redmond and other Crook county towns, It being alleged, particularly in regard to Redmond, that disorder ly houses and their retinue, as well as gamblers and others of disreput able character, had flocked Into Red mond.. The governor, with his formal uotlucation, declared to the sheriff that he expected the civil authorities to take the matter In charge and clean up tlie conditions or the execu tive office would take the matter in hand. At Huntington It is probable that Justice of the Peace Wood has not heard the last from the governor. His name figured in recent newspaper reports from that place. At sump ter and Redmond ft Is reported that some of the officials have openly de fied the governor. That these towns will be among others to come within the limelight through their official;: and through the governor's latest pol icy, as announced today, is certain. It is probable that action will n-jt be deferred for long. As far as the move against sheriffs is concerned, there are two ways, it is stated, aside from the statute quoted, to reach them. One Is through an action brought by the state on the bond of the sheriff and another Is through a suit brought by taxpayers to enjoin payment of that official's salary. "Under this statute," the governor declares, "It Is possible to prosecute practically any public officer for failure or neglect to perform his duty, and the statute Is so broad as to even make It a felony, whether the neglect was particularly Intended or not. "There are several municipal and other officers In this state who have been sitting idly by and allowing the laws and ordinances to be violated under their very noses. I have the 'dope' on a large number of such officers, and when the time comes a bomb will be sprung which will not be an exceedingly pleasant explosion for some of them. "There seeniB to be something of a problem as to district attorneys. 1 If any district attorneys have ne-j glected their duty and failed to per-i form their public services as they should have been performed, there is some doubt as to who should pros ecute such district attorney, nl tbough I believe the code Is broad j enough to allow the court to ap-i point a special prosecuting officer."! Apparently the move at Hunting-; ton, the attack on the roadhouses In j .Multnomah county by the state mil!-j tia, the various letters and confer-! encea with some officials of other j cities, are but the preliminary bouts j to the main state battle which Is : scheduled for the near future under the direction of the governor. At the present time the governor j Is mentioning no names, nor Is he I Indicating any localities which he has j in view. Brown leaves in a few days for Cur ry county where he will attend the regular term of court. Mr. Brown has a couple of very important cases scheduled for trial In Curry county and It will puzzle him to get hack to Roseburg in time for the special term of court which convenes on Sep tember 2.
