The chief matter discussed ut last
evening's meeting of the citycoun
city, which, by the way, was the
most peaceable event In the history
of the present administration, was
tlmt of deciding wnether or not to
grant the request of J; P. Denn,
who solicited the return of his team
upon the grounds that the city had
neglected to carry out its part of the
contract wheu it failed to remit $450
- the stipulated price of the animals,
on November 1.
Mr. Denn was present ut last even
ing's session of the council, and per
sonally demanded the return of the
team. He explained that he sold the
animals to the city with the express
understanding that he was to receive
his money on November 1, and not
some twenty days later. Mr. Denn
said he sold the team to the city at
a sacrifice in order to obtain money
on November 1, and Inasmuch as the
municipality had lulled to live up to
its agreement ho desired the return
of the ainmals without delay.
In explaining the position of the
city in the matter. Councilman
Strong said that he bargained for the
purchase of the team from Mr. Denn.,
and to the best of his recollection,
informed the gentleman that he
would receive his money on Novem
ber 1. "At the time 1 did not men
tion the fact that an ordinance auth
orizing the expenditure of the money
would be necessary." said Mr. Strong.,
"reeling that Mr. IKmiii would be
willing to await the convenience of
the council. Today 1 offered him a
warrant for $4."0 and he refused.;
saying that lie had been ottered $."oe
for the team. As tar as i know he
made no previous demand for the
money."

cilman Clark advanced a motion to
the effect that the city refuse to re
turn the team. Prior to being placed
to a vote, Councilman Strong asked
for a legal opinion from the city at
torney, who, In response, advised
the council that there wero several
legal questions involved. The mo
tion was then voted down. Zurcher.
Mullen and Clark casting theii bal

Upon hearing the result of the
vote, Zurcher made a motion .that
Denn be compelled to remove his
horses from the stable at once, and
thus save the expense of their feed
ing. This declaration angered Denn,

Al Creason again brought up the
matter of installing lire hydrants in
North Uoseburg, and as usual, the
proposition was referred to the com
mittee on fire and water.
hdward Lenox asked that some
action be taken relative to Installing
a bridge at tho intersection of Spring
and Lane streets, and the matter
was referred to the city improvement
committee for investigation.
The city improvement committee
reported that the heavy expense In
the engineering department was
raching an end, and It was hoped
that all work now in progress would
be completed within a couple of
weeks.
In accordance with the recommen
dation of the committee, to whom
waa referred the mayor's message
for distribution. Mayor Micelll has
been authorized to appoint ten citi
zens to act as a civic improvement
committee, and work in conjunction
with the council in their efforts to
beautify tho city.

bid for constructing a newer in block
No. J9, in Kinney's Addition. The
sewer will cost approximately $u:i5.

motion of Councilman Mullen the
matter of awarding the contract
was deferred for one week.
A resolution introduced recom
mending that a water pipe be laid
on Second Avenue, in North Rose
burg, was referred to the lire and
water committee for investigation.

As predicted in a recent Issue of
Tho Evening News, Councilman J.
L Fullerton last evening introduced
i resolution, in preliminary to the
establfsament of a municipal water
lystem In Rosebtirg.
In explaining the resolution, Coun
ilmeu Fullerton said that Uoseburg
was growing rapidly, and the time
was not far off when some provis
ion would have to be made relative
o enhancing the water supply. Mr.
I'ullerton did not contend that- the
ntire system should be Installed at,
nice, but thought it would be weli
.o Investigate, and if possible, secure
i water right.
While Councilman Fullerton hat
ieeu unable to ascertain tho approxi
nate cost of a municipal water sys
em. a number of the council men are
if th opinion that it cannot be in
filled for less than half a million
lollars. This sum will include the
ost of the main supply pipe, which
.ill necesasrily extend a distance of
'(i miles up the North I'nipqua river,
it is said that a sufficient supply of

Following is tho resolution as
submitted by Cuncilman Fullerton
and adopted by the council:
' Whereas, It Is of tho utmost im
portance to the inhabitants that the
city be supplied with an abundant
supply of good, wholesome water,
and that the city should own and
ronirol lis supply of water, and the
means of conveying the same to the
city; and.
Whereas, the only available
source of supply of good wholesome
water is tlie North Umpqua river,
and its tributaries, and that there
is danger of the waters nf said
stream at the points where the same
could be diverted and conveyed to the
city most cheaply will be appropriat
ed for Irrigation and power purposes,
and that In order to secure waters

poses it is necessary that this council
I take prompt action. Therefore be it
"Resolved:
"1st. That a special committee of

tho wants of the city, assuming that
it continues its present growth, and
report the earliest date practicable."
Committee Is Appointed.

men Fullerton, Strong anil llouck as
mem hers of the committee requested
in the resolution. While a number
of the councilmen contend that tlx
preliminary investigation will cost
the taxpayers of Uoseburg not less
than $fj,0H0. others believe the work
can bo accomplished for a few hun
dred dollars.
