No person or persons shall allow tho contents, filth or poi sonous subHtiiiice from any sink, sewer, cesspool or drain to flow out upon tho Htreet, sidewalk, or under any sldowulk or Into any alley or upon any lot or srounds adjoining his or her premises. Sec. 12. It Is hereby made the duty of every owner or owners of any ditch, canal or other waterway,! within the corporate limits of the J city of Uosehurg, Oregon, now ori hereafter constructed, to cause run- ning water in such ditch, canal orj waterway, so a? to prevent the foul-; iiiK of water therein, or cause tile to he luld in such ditch, canal or waterway to dialn the same. If tile are laid tho same shall he covered to the level of the surface of the ground. Upon failure of such owner or own ers to comply with either of above requests, it Is herehy made the duty of the chief of police to fill such ditch, canal or. waterway, or cause the same to be filled and make the cost theerof a lien against the abutting property, provided,! .how ever, that the chief of polico shall first give written notice to tho own er or owners of such ditch, canal or waterway, also to the owners of property abutting on such ditch, can al or waterway. Sec. 13. It shall be unlawful for any person or person to kill or slaughter, or cause o be killed or slaughtered, within the limits of the city of Uoseburg, any animal or ani mals, the flesh of which Is sold or offered for sale or intended to be sold or offered for sale, or to erect, mo in tai 11, or use, or cause to be erected, maintained, or used with in said city of Roseburg any house, shed, building, structure, yard, lot, plnco, block or enclosure, or other building or place as a slaifgltter house. No person or persons shall, with in tho corporate limits of tho' city of Uoseburg, keep or store any un cured or green hide or hides of ani mals In any house, store, building, or other place where the same shall a use or create a noisome or of fensive smell or atmosphere, or In such manner so as to hecomo of fensive to persons travel I tig along the public streets of said city or to owners or occupants of premises ad jacent thereto.. Sec. 1 I. No person or persons shall offer or have for sale or do liver to any person In tho city of Itosebuig. nnv unwholesome, water ed, or adulti t a ted milk, or milk known as swill milk, or milk from cows that nre fed on swill, stagnant water, garbage or other like sub stance, or any butter or cheese made of such milk. See. 1 r. No person shall carry, convey or haul through or upon any street within the city of Roseburg, any fresh meats of any kind unless the same shall be securely covered by a canvass or other suitable cover, so that all meats shall ho protected from dust, flies, and shall not be exposed to public view. Sec, lt. All meat markets with in the city of Roseburg, shall be kept in a good, clean and sanitary condition and no carcass or part, of a carcass shall bo allowed to hong on tho outside of such market or on tho Insldo thereof, in such a man ner as to become contaminated by dust, dirt or files. Sec. 17. No person shall sell, ex pose for snle, or offer for sale or deliver for human food any tainted, diseased or bad meat, poultry, fish or game, or the flesh of any calf less than four weeks old when slaughtered, or any unsound, decay ed or uuwholesomo fruit, vegetable or other market produce. Sec. 18. No owner, lesseo or man ager of any meat market within the city of Roseburg. shall receive for the purpose of sale, any meat from any slaughter house, unless such slaughter house shall meet in every particular the leiiuirement of t he suite law and the rules of the Ore gon Hoard of Health, in that: First Tho killing room shall be supplied with a tight, well drained floor, with sewer connections where possible, nr an approved ccrspool with covered sewers where a sewer age system is not available. Second All rooms used for re taining hides, glue stock or by-products, Khali be thoroughly drained and so situated that no offensive od ors will pecntrato to other apart ments where meats or meat fond products nro handled, and all hang ing floors, refrigerators and cool ing moms shall be well ventilated ami kept in a thoroughly sanitary condition. Third llooks. offal, racks and rails shall be kept clean and sani tary In every respect, and all offal, refuse, horns, blood, waste or by product!! shall be removed once dally, and all buckets, tubs or re ceptacles in which they are deposit ed shall be cleaned and d'.sir.f. ted from (imp to time. Fourth- Carcasses shall not be dressed with skewers, knives or oth er lnstrumqnta that have been held in the mouth. Skewers shall be dis infected and cleaned before used again; r pit ling on whetstones or steels when sharpening knives shall not bo allowed, and all water used In washing carcasses shall bo pur and frei from contamination. Wells shall be covered and so protected that no animal contamination can gain access. Fifth Hogs, when kept in the vicinity of slaughter houses, shall not be allowed nearer than two hundred feet to the buildings used for killing purposes, and all waste products bhall bo cooked before be ing fed to pigs. Any, or all persons, who ' shall sell, expose for .sale, or offer to sell to the public any meat contrary to the provisions of this section shall, upon conviction thereof, be punished as hereinafter provided. Sec. 19. The term, person or , persons, as used In this ordinance, shall Include all individuals, asso ciations,, partnerships, companies ' or corporations. Sec. 20. That the doing, allowing or permitting to be done, any act contrary to 'the piovlsions of this ordinance Is heieoy declared to be a public nuisance, and unless the owner or occupant of any place, pre mises, yard or lot shall abate or remove tho same within forty-eight hours after receiving notice from the committee on Health and Police so to do, such owner or occupant as aforesaid shall be deemed guilty of a misdemeanor, and upon conviction thereof before the recorder's court of the city of Roseburg, shall be fined for each offense not less than five nor more than one hundred dol lars, or be Imprisoned in tho city jail not less than two nor more than fifty days, or by both fine and imprisonment; and in case such own er or occupant neglects or refuses to abate or remove such nuisance when notified so to do, as aforesaid, the said committee ori health and police of said ciay of Roseburg Is hereby authorized to remove or abate the said nuisance as hereinafter direct ed, and the cost of such removal or abatement shall be made a Hen on the lota or premises Svhere cuch nuisance existed. Warren Reed, the Gardiner lum berman, Is spending the day In the city attending to business matters, Mr. Reed says that Gardiner is pro gressing notwithstanding tho recent fire, and he anticipates that the burned buildings will be replaced within a short time. L. H. Rhoades, proprietor of a local second hand store, has filed a suit in the Justice court to recover certain goods valued at $7 ft. 50, to gether with $5 damages. The de fendants are Robert Farnsworth and George McClelland. The plaintirf Is represented by Attorney C. S. Jack son.
