Lelack told The Nugget that until an actual bound- ary proposal is made, it’s not clear what County jurisdiction would be on any of those matters, and the question of conditional use for skydiving would, in any case, likely be a matter for staff, not the commissioners. The extent of the bound- ary that would ultimately be defined by state recogni- tion is a significant one for concerned local residents, because, as County Planner Peter Russell notes, “For these airports, aviation uses are outright permitted on land within the airport boundary regardless of local land-use regulations. Lands within the airport boundary are lands either owned by the airport or leased for long-term use, or committed to airport use.” It remains unclear what the proposal currently before ODA entails. Airport Manager Dave Campbell 29 says that no formal appli- cation has been made. The County’s action in deferring discussion indicates a lack of clarity as to what boundary will actually be proposed. A public hearing will be scheduled by ODA in Deschutes County when an application is deemed com- plete. Assuming that hap- pens, “affected property own- ers” — those whose property is within 500 feet of an air- port boundary, within an approach corridor, or whose use of their property may be directly affected if the pro- posed airport is listed — will be given notice of a public hearing.
