Batang, China, June 4. Reports re ceived today from Thibet say the Chinese are regaining the upper hand In the rebellious dependency. At least accounts the Chinese forces from Kansu and Szechwa provinces were converging upon Lhassa, and it is like ly that, by now, they are besieging or In possession of the Thibetan capital. More than this, the Chinese military commanders have won the friendship of the Thibetan tribes along the fron-. tier of China proper, and many of the tribesmen Joined the Chinese troops In their march on Lhassa. The success thus far of the expedi tion sent against the rebels speaks highly for President Yunn Shi Kal's Judgment In the selection of Its lead ers. Not only have the Chinese sol dier's been well handled, from a mili tary standpoint, but an Important dip lomatic triumph has been achieved, In dividing the Thibetans among them selves. The greatest danger to the Chinese is that of English interference. Though the British government has denied any such Intention, Jt is far from be ing trusted by the Pekln administra tion. SOLD JH TO WW ra IS TRYING TO RECALL LEASE (Continued from Page 1.) tiff sought to make a recall on the lease, so to speak, and have It can celled. "No complaint against the defen dant's operation of the yard came un til last fall and we will show by evidence, and I want to say right here, not by Chinese evidence, as has been asserted, but evidence by bop experts, that the yard was run In ac cordance with the lease and in skillful manner. We will show by ovldence here that the plaintiff has harassed and annoyed the defendant In the operation of the yard. We will show that he Incited the hop pickers to strike and that this Inter fered with the hop picking. We will also show that the plaintiff had a suit Instituted to eject the defendant but that the case was dismissed and that he also had one of his employe's arrested and that the case against him was dismissed. Attorney Carson then went on to explain the different charges pre ferred against the defendant. The ytlina and warehouse had been re paired, lie declared, in accordance with the lease aiul eome of the build ings erected by the defendant. Wire was not used In the hop yard be cause the lease had not contemplated It as wire was not used when it was executed. Peers, realizing this, had furnished the wire when It was to be used and McMahan had failed to do so, The yard was not as well sup plied with poles as It should be, he admitted; but this was due to the fact, he explained, that the plalntllT had forbidden the defendant to cut timber from the land to be used as poles, and the defendant was not to blame for this condition. "The plaintiff finds fault with the Inartistic Implements used to culti vate the yard," sarcastically said Carson, "but we will show that they were adequate for the work and bIbo that his cutlvatlon was In accord ance with the Ideas of expert hop men. "And then there was the geese," he continued. "It Is outrageous to think of a Chinaman owning geese and thoue geese getting over on the plaintiffs clover patch. But the evi dence will explain all the expeditions of the geese Into this patch to the satisfaction of the court." After declaring that he would ex plain to the satisfaction of tbo court all the allegations made against the defendant and that he was satisfied of a verdict In his favor, the attor ney for the defense concluded his ar gument, and the taking of evidence was commenced. - McMahon was the first witness placed on the stand thla morning, and after he had told his story about how the lease had been violated by Sing, In falling to properly cultivate the yard, keep up the buildings, nnd fences and by allowing his hogs and geese to run wild, Attorney Carson put him through a grilling croBB-examlnatlon. Attorney Carson desired to know If he had found anything In the lease about geese, and McMahon was forced to admit that he had not, and the fact that they run at large could not be considered as a violation of It. He drew the same admission from him with relation to the hogs and divers other thlngSj After Carson was through with him he had trimmed his case down until he had but one leg left to stand on, and that was the fail ure to properly cultivate the yard, and the attorneys for the defense declare that when this afternoon they place expert witnesses on the stand to testi fy on this subject, that this leg will also be knocked out from undor him. The next witness on the stand was B. T. Jones, and his evidence was weak. J. L. McLean's evidence, the next witness, was so weak that the attorney for the plaintiff, after a few minutes' examination, let go of him like a hot potato, and the defense did not even bother with a cross-examination. P. Case was the.next witness, and, Foster & Baker GROCERIES Fruit Jars TJlio season for fruit Jars Is here, when In need of Jars, caps, or rub bers, como In and see us. "My desire Is to write a fnw linos n l,.t vnn ltnnw alms Mrs, Zubrrt and Bas. to all my friends." finding that he knew nothing about any of the matters, save cultivation, and but little about that, the attorney for the plaintiff Bet about extracting what he knew about It, and It was like extracting teeth with connected roots. Carson made the assertion In his opening statement that the suit was brought for the purpose of railroading Sing off the farm, so that McMahon could get all of this year's crop, aid that there are others not connected with the case who believe the same thing was evidenced this morning, when a prominent lawyer attending the case as a listener, leaned over to several luwyer frloiiiis and declnred that, "while he had not hoard much r44 SUMMER WEIGHT UNDER Ladies' Sleeveless Vests, a good quality at 10c Fine Lisle vests at 18c and 25c Ladies' Sleeveless Union suits, lace trimmed .38c Extra large Union Suits, fine Lisle at 50c Extra large Sleeveless Vests, at 121 -2c Children's Warm Weather Underwear Summer Union Suits for Girls and Boys Separate Garments for the Little Ones.
