When the supreme court this after noon handed down a decision deny ing the appellants a rehearing in the case of the Krebs Hop company against T. A. Llvesley & Co., defend ant and' appellant, there came to an end, at least bo far as this concerned, all litigation between these parties In tbe supreme court. The suit was Instituted by the Krebs Hop company for the purpose of obtaining damages for the viola tion of a contract, and in one form oi another it has bobbed up in the supreme court seven or eight times. Several months ago the supreme court decided in favor of the Krebrf company, and a rehearing was given Llvesley & company, and now the cnurt dismisses that The question Involved was that of damages. 'When the plaintiff dellv eied the hops the defendant offered eight cents when the contract provid ed for 14 cents, while the market price was seven cents. The defen dant claimed that plaintiff shoull have accepted the offer, making a d'fference in damages of $1,000. The supreme court adheres to Its former opinion, maintaining that the rule for damages Is the difference between ihe market price and the contract price. Other Cusps.
