Van Alton Deputy District Attorney Wlnslow today directed thai a war rant be Issued for the arrest of Charles S. Lowe on the charge of ob taining money by false pretenses. 1 The offense Is alleged to consist In Lowe prevailing upon Van Allen to go security on a cote for $200 by falsely representing to him that he bad a $500 Interest In a contract for the conveyance of a certain tract of real property. Prior to signing the note Van Allen had Lowe execute a contract giving him the equity held In the property as security and this document will be the principal evi dence Introduced agalniit Lowe to prove the charge preferred against him. " When the note fell due Lowe failed to meet It and Van Allen paid It. Af ter paying It he made an Investiga tion as to his security and found that Lowe had never had an Interest In the land as represented by him, and at once took steps to arrest him. o WHAT IS DOIXO AT WILLAMETTE , The basketball tea in of Willamette will begin some hard work today In order to prepare for the game with the Washington State College next Thursday evening. The game promlsus to be a hard, fast one and will probably be the last one of the season for Willam ette. The local tinlverslty has not been defeated and th e team Is confi dent of winning from the Pullman bunch. The Washington State Col lege will make a tour of the Oregon colleges, playing 0. A. C. first to night She will play Oregon at Eu gene two nights In succession and the next night will meet Willamette. The scores made against the Wash ington team will show the relative strength of Willamette and Oregon. Oregon won" from Pullman on nor northern trip and bent every other team In Washington with the excep tion of being defeated In one of Its two games with the University of Washington at Seattle. Wlllnmotte has won from O. A. C. In two games and dofeated the fast Mt. Angol col lege team twice nnd Dr. Sweetland thinks that Willamette can defent Oregon on hor own floor. Austin Flegel and his gang of stu dent laborers are making rapid head way on tlio track and baseball field. The baseball diamond has been en tirely covered with clay and rolled lightly In order to nuub the clods. The next rains will pack the clay and a heavy roller will smooth it off 'splendidly. The track will probably be completed In two weeks. There will be men out running Just as soon ! as It Is completed. Dr. Sweetland is ' considering whether or not to pur l chase the fence and grandstand' of j the League grounds on Asylum ave nue and place them on the Willam ette campus. In case he decides not to do so, the building of a new fence and bleachers will be started soon. o THE REASON FOR THE SUIT HAS CEASEO Contending that all the grounds which may have existed for the bring ing of the action, have ceased to be, Attorney General Crawford today filed a motion with the clerk of the circuit court In which he asks the court to dismiss the case of Daniel E. Powers against F. W. Benson, sec retary of state, and State Treasurer Steel. This suit was brought by Powers for the purpose of restraining Assis tant Attorney General Van Winkle from drawing his salary on the ground that the law did not provide for the creation of such an office. The state demurred to the complaint but It was over ruled by Judge Har ris, of Eugene, but an Injunction was never issued. The attorney general now takes the position that the appropriations made by the legislature two years ago have been xhausted and that the last legislature through a bill creat ed the office of assistant attorney general and also provided for his salary and that, therefore, there are no grounds left for the further prose cution of the suit. Although Attorney-General Wlckcrsham and other members of the government were present, expecting decisions In the tobacco trust nnd other Important cases, the U. S. supreme court ren dered no decisions this afternoon. o Thirty Froie to .Death. Astrnkan, Russia, Feb. 27. Thirty men who formed the crew of an Ice boat on the Caspian Sea, were found today frozen to death. Their iceboat had plunged Into a crevasse and though the men escaped the water, they froze before they could reach a fire. The same condition exists on the part laid on Mllwaukoe street, between Beacon and Ilolgate streets. Only the west side of the street was paved. Mayor Simon has assured the property owners that no defective work on Mllwaukie street will be ac cepted.
