Cans, Bent Jones, E. T. Malvln and O. A. Nendnll. After tho testimony for the stato was submitted tho defenso moved n dismissal of the suit, and this motion took up tho time of tho court until adjournment. Aftor hearing tho argument of counsel, Judgo Fraser dismissed tho Information and discharged tho de fendant, .for tho reason that tho act complained of did not constitute u crlmo under tho laws. As Mr. Mc Clanahan was not permitted to testi fy, his sldo of tho caso did not como boforo tho Jury at all. In discussing tho matter, aftor his dismissal, Mr. McClanahan said that, whon tho un fortunate incident occurred on tho road near tho penitentiary last sum- mer, ho checked his automobile whon the owner of tho horso raised his hand In protest against tho fast ap proach of tho machine. Ho stopped his engine, and slowed down, coming almost to a standstill, and, after pass ing tho rig, and about 75 yards beyond it, he again started tho engine, and It was tho nolso mado by'tbo ma chlno at that time Uiat frlghtoned tho horso and caused tho wreck and tho runaway. Following tho dismissal of this case and the discbarge of tho Jury, tho enso of tho stato againBt B. O. Parsons was called. Tho defondant was an em ployo at the asylum, and was arrest-; ed on tho chargo of stealing a quanti ty of goods from that institution. Ho has been in Jail for tho past threo months, awaiting trial. Parsons was an omployo at tho asylum whon his wife brought a divorce suit against him, and In tho complaint alleged that hor husband had long beon guilty of stealing goods from that InsUtutlon. Ho was promptly suspended by Supt. Calbroath, of tho asylum, and was in dicted, and, later, arrested for tho crlmo, since which time ho has boon in Jail. Thero is a largo list of lilds and It will tako several days to ' dlsposo of tho work of listing tho bids and awarding tho contracts. In somo lines of provisions tho price appears to bo qulto an advance ovor that of last, summer, but this Increase Is lm-i material. In tho caso of meat?, B. C. Cross, of this city, again secured tho contract at $7.98 per hundred pounds, as against $7.90 last January, and 15.C0 last July. Tho Increaso ovon last summor's bid Is duo to tho fact that In summor stock was much cheaper, rango cattle bolng available for tho uso of meat markets, whllo tho contract for tho next six months will havo to bo filled with stall-fed stock, which Is necessarily much high-) or.
