In his opinion, says: "Your question of tho 28th, nit., relative to the division of school dis trict No 44, lying partly In Sherman county nnd partly in Gilliam county, was referred to Attorney-Gtneral Crawford, and he remanded the same back to me to answer, with the In structions that he was of the opinion that the district boundary board of ailllam county could organteo a dls frirt nut nt Ik own territory, so long ns tho boundary was not changed in that portion of the district lying in Sherman county. The session laws oi 1003. uaco 125. provides that 'Any rhnnso nt the boundaries in the other county must be concurred In by the district boundary board of that coun ty." In the case in question, there be ing no attempt to change the boundar ies of that portion of the district lying In Sherman county. I am of the opin ion that It Is not necessary that the boundary board of Sherman county should concur In the action of the Gil liam county board." !
