The Prohibitionists lie-in a Contest
Against the Other Fellows.
Suit has been begun In the circuit
court by the state of Oregon, upon
the relation of P. A. Davis, John
Hieks, J. ('. Hayes and C. I.. Smith!
candidates on tho prohibition ticket
at the recent municipal election at
Silverton, agalnstAdolph Wolf, M.
Fitzgerald, Geo. Sacra and Archie
"Wolfon!, who wero the citizens' ticket
nominees who were "counted In,"
on the representation that the tick
ets cast by tho"prohis" were printed
on a tinted paper, which made the
ballots illegal.
Tho complaint alleges that on tho
tlrst Monday In May, 1888, the re
lators were duly qualified electors of
the city of Silverton, etc.; that on
said first Monday in May, a general
election was held under the act
incorporating tho city of Silverton;
that at said election, tho wild P. A.
Davis, John Hicks, J. C. Hayes and
E. L. Smith, and one A. I. Coolidge
received tho greatest number of
votes for the otllco of councilman;
that the four first named accepted
tho olllce and havo been and are
still rightfully entitled to hold, use
and cxercibo the said otllco of coun
cilman in said corporation.
But notwithstanding, etc., tho
defendants continue to act as coun
cllmen, without any authority
whatsoever, and still exercise the
otllco and all tho rights and priv
ileges to the Mild olllce appertaining,
which wild otllco and privileges the
said defendants for allthotlmeaforc
Biild, (since tho election) have
usurped, intruded into, and unlaw
fully held and exercised', altil still do
usurp, intrude into and unlawfully
hold and exercise tho said olllce to
tho great damage and prejudice of
said relators.
Wherefore, nlalnlifls demand
judgment:
1st. That tho defendants are not
entitled to said olllce of councilman
and that they bo ousted therefrom.
2d, that tho said relators are en
titled to said olllce, and to assume
tho execution of tho .duties of the
same, on taking the oath prescribed
by law, and that thoy bo put In pos
session of tho Hiunonpon being quall
lled, and for tho costs and disburse
ments of the action.
N. B. Knight and J. .1. Murphy
appear ius attorneys for tho relators.
An answer will probably be filed,
soon.
