Tho complaint alleges that on tho tlrst Monday In May, 1888, the re lators were duly qualified electors of the city of Silverton, etc.; that on said first Monday in May, a general election was held under the act incorporating tho city of Silverton; that at said election, tho wild P. But notwithstanding, etc., tho defendants continue to act as coun cllmen, without any authority whatsoever, and still exercise the otllco and all tho rights and priv ileges to the Mild olllce appertaining, which wild otllco and privileges the said defendants for allthotlmeaforc Biild, (since tho election) have usurped, intruded into, and unlaw fully held and exercised', altil still do usurp, intrude into and unlawfully hold and exercise tho said olllce to tho great damage and prejudice of said relators. Wherefore, nlalnlifls demand judgment: 1st. That tho defendants are not entitled to said olllce of councilman and that they bo ousted therefrom. 2d, that tho said relators are en titled to said olllce, and to assume tho execution of tho .duties of the same, on taking the oath prescribed by law, and that thoy bo put In pos session of tho Hiunonpon being quall lled, and for tho costs and disburse ments of the action.
