CAN'T SELL FISH OF ROGUE RIVER Attorney General Furnishes Master Fish Warden With Opinion in Mat ter of Selling Salmon Taken in ths Waters of Local Stream. PAGEMYE frg Refinement That no variety of fish, slcclhoml trout or snlmon, taken in the waters of Roguo River will now bo lnwfuly sold is thq opinion of tho Attorney General, who sots forth his viows in tllo following letter to tho master fish warden, which is self oxphuui tory: Snleni, March 9, 1911, Mr. R. E. Clanton, mnstcr fish warden, Cnpi tol building. Dear Sir: I hnvo vour fnvor of tho 7th instant, enclosing copy ot IIouso Bill No. 184, enacted by the recent session of tho legisla ture, together with copy of the Rogue rivor fishing laws, enacted at the last election, and asking my opinion thereon, whothcr, after said IIouso Bill becomes effective, it will ho lawful to soil salmon, other tluui stcclhcnds, tnken from Roguo River with n hook and lino., I would answer your question in tho ncgativo for tho reason that said !.l!l,'ni:.. i 1 1 . ""' uvi unities u cuiiuiuini closed sensou on snid river by nny menus, i except with hook nnd line. Section j( 1 of said Houso Bill 184 makes it un- lawful nt any time to soil stcolhend,!! or trout. Section 2 mnkes it unlaw-"It! ' L ful during any closed season to soil salmon, other thnn stcollipmls, and jhero being n continual closed senson, it is, therefore, unlnwful to sell such salmon, other than steclhcnds, at any timo, although it is lawful to take them with hook nnd lino. The evident intention of the legis lature in passing House Bill 18-1 was to allow salmon, other than stccl hcnds, to be sold whenever thero '.h an open senson, but the bill provid ing for open nnd closed seasons hnv ing boen vetoed by tho govornor, leaving tho initiative net providing a continual closed season in force, thero is no open senson, nnd, therefore. such salmon cannot bo sold for want of an pon senson.
