Our Correspondents JACKSONVILLE ITEMS GRANTS PASS, Feb. 1. The test case, the State versus Ilenni, has been tried before Judge- Calkins? in the circuit court, and the defendant was found guilty by the judge. ,TJio judge sentenced him Va 15 days in' jnil nnd $250 fine. The parties agreed to nil the facts, the defendant admitting that he sold the Kiiuds, but contended that the Home Rule amendment repealed the local option law, and therefore re pealed the punishment of the crime. Robert Smith, counsel for Hcarn, immediately took the necessary step3 for taking the enfie to the supreme court for appeal, when it will bo de cided once and for all whether or not the local option law is in force in the city of Grants Pass. This will bo the firet caso to go up to the highest court on this ques tion. If tho decision of the circuit court ia uphold it will mean that the people can not hold elections in pities now under the operation of the local option law before November, 1911, and possibly Grants Pass may not be permitted to vote on the question until November, 19122, because whei the county is' dry 'as a whole- it is V provided that no election can be JjT held in any part of the county fo two years thereafter, and tho local option law passed, ,in 1910. If the decision of Judge Calkins is reversed Grants Pas's may licenxo saloons, but if licenso should be granted before the supreme court acts on it, every license will be subject to nrrest, for such licenso will not protect tho snloon men. The liquor cases would, ordinarily have come up in April, but tho test case wns rushed in order to get a two months' start. Attorney Smith's brief will be filed in a few days, and in all prolmliilit a final decision will be mode enrlv - the summer. PORTLAND SHIPPERS LOBBYING IN SALEM L. O. When first brought into the unac customed surroundings of tho court room, tho women jurors exhibited some nervousness, although they smil ed as if enjoying the sensations. When the lawyers opened their arguments, tho jurors became very attentive.
