Wednesday, March 15, 1905 EQUITY WINS THE KEYSTONE CASE A decision roudorud by Judgo Eakiti, of Lb Graude, settles, so far as tbe oiroult court is oouueruod, the suit brought by the Keyatoue Miuiug & Milling company against the Equity Goppei & Gold Miuiug com pany, which case was referred to W. J. Coletnau, the court reporter, who took tbe testimony in CanyouCity laat fall. The suit was brought by tbe Key stone aompany to enjoin tbe Equity company from taking ore from oithor tbe Oregon or Colorado quartz claims, and fur damages. Judge Eakiti, lu bin fludiugt of fact aud ooucIuiIuub of law, says that "tbe testimony is very conflict iug and uttsatisfaotory as to any Huu or corner of the Koystoue. That there is no ooutliot between tho Colo rado aud tbu Koystoue mining olaiuiH. That tho Oregou conflicts with tho Keystouu only about 150 feet at the south oud of the Oregon, and that none of tbe workiugs of tbo Oregou mining claim are on the Koystoue." The Badgor company seeks to es tablish its right to a half interest In tbe Stockton claim, the priuoipal proporty nf tho Stockton compauy. Tbe claim adjoins tho sido lino of tbo Badger claim, tho vein of tbo lattor aud also of tho Bull of thu Woods property cutting through tho Stockton. Tho Badgor company alleges that it has purchased tho rights of William Morau, who, sev eral yoars ago, bought a half Inturest iu tho Stockton, on tho condition that bu was to do oortain dvolnp meut work. Tho Stockton ownors stato that Morau druvo a tunnel, found nothing, and abandoned his interests, which wore later preserved from lapsing to tho government by II. 11. Ames, A. J. Simmons and asaooiates. It. is said that tho afllda vit of Morau has been secured by tbe Stucktou mauagemeut in dofouso of its title, wbliu cu tho otbor baud, the Badget compauy exhibits a doed from the same individual, Tho Badgor, owned by au alliod compauy to the famous Buukor Hill aud Sullivan concern of Coeur d' Aleuo aud Alaska fame, la ono of tbo best mines iu eastern Oregon. It has produced for several yuars a remarkably rich grade uf galena gold ore, aud is said to have ou the 700 foot level tbo bust grado of oro yet opened in tbe iiiluu. Tho surveying party rsportod that a rich Badger shoot was pltchlug toward the Stockton. Tho last year the Badgor mauagemeut sank to tho 700 level, where remarkblo galeua has beun mined. Quickly ou this develop ment came the report that tuu com pauy aud bought thu old internal ot Morau and would esatablisb its title. This suit is the rosult. Ownors of tho Stockton express their belief that tho Badger has found tbe main shoot pitching into tbelr grutiud, aud that this suit is thu commencement of au effort to get coutrol of tbe adjacent property, so as to prmit miuiug therein. H. 11. Ames, one of the priuoipal owuers, wboee brother, G. G. Ames, Portland attorney, la conduoling the defeuso, was there and gave hie testimony re cently, ile brought some of tbe ore that was said to cume from the 700 level of tbe Badger, proving that it is exceptionally high grade. Mr. - BADGER Ames also said that a rumor was cur rout to the etruct that the Badger, ou tho 700 level, had gouo across tho liuo aud was taking out Stouktou oro. Hyatt, superlutuuunt or tho Oregon-Iowa company, operating tho famous old Morns silver mine, iu the Greenhorn mountains, passud through Sumpter today ou route to Bourne on a business trip. Albert Loy aud sou, Sam, camo down from tho Cracker Creek hills yesterday, returning this afternoon. They are developing a big ledge at thu head of Big Cracker and aro being encouraged by a magnificent surface showing. The mall service between Prairio City aud Comer has been lucreased from a tn-weekly to six times a week service. This gives the miuiug camp at Quartzbiirg about as good a mail service as that enjoyed by auy part of Graut county. The circuit court uf Grant couuty has decided tho case of tho First National bank of Tekauiu, Nebraska, vs. the LltltH Giant Gold Milling company in favor of the plaintiff, by awarding judgment for 83H.ll aud uosts, and declaring the plaintiff's mortgage valid. Sale ia ordered under foreclosure. Ed. Huto, Jr., superintendent o the Little Cracker mine, above Bourne, returned this morning from Baker City, where ho has been lu atj tendance upon the bedside of his father, who was reported to bu dying a few days since, which report was. fortuntely, untrue and he is now much improved. On March 7 a deed was tiled for record iu Graut couuty, showiug tbu sale of a one-sixth interest iu the Psyche, Venus, Missing Link and liidepeduucu quart, claims by J. T. Donelly, the Baker City baker, to Bela Kadisb, now of Goldfleld, for $4100, iiud the transfer of another sixth interest in the same property to Fred D.
