MARSHAL IS HELD CHAEGE OF MANSLAUGHTER AGAINST OFFICER. Mystery How Bullet Struck a By stander Who Wat Behind the Shooter Oat of Range. W. H. Lucy, city marehal of Prairie City, who was arrested on the charge of killing Ernest Hickman in Len Woods' saloon, on the morning of April 29, was examined before Jus? tice J. W. Mack, and bound over to appear before the grand jury on the charge of manslaughter. . He immedi ately furnished 12000 bonds. The three women witnesses were held un der $250 bonds each, which they furn ished in cash. The justice, in renderiug the decis ion, stated that although the evidence produced by the state was far from satisfactory, owing to the intoxicated condition of the witnesses at the time of the affair, and the mystery concern ing the shooting, which had not been cleared, or explained away by any of the evidence, still, as the defendant waived examination, he would hold the defendant, not on the charge of murder but only that of manslaught er. Eleven witnesses were produced by the state (none by the defendant) of which eight were present at the time of the shooting, in a much intoxicated condition, who all agreed that Marsh al Lucy, the defendant, did the shoot ing that killed Hickman; that the trouble between the women and inter ference by one of the men created an impression that serious trouble was pending, which the marshal tried to prevent, but which Hickman objected to, by placing his flat hand on the marshal's breast and pushing him back (so he fell on the floor, one of the witnesses testified) saying that he was running the house. When the marshal got ou his feet the shooting oocurred, by which Hickman was killed and Haight was wounded in the leg. This in brief is the evidence by the eyewitnesses. ; , However, there is a mystery connected with the shooting which was not explained. The mar shal was facing Hickman at the time of the shooting, and Haight was stand ing eight or ten feet behind the mar shal, according to the evidence ; still the bullet went through the body of Hickman, just below the ribs, and the gpont bullet must have struck the wall, bounced back and struck Haight in the leg, which is an utter impossi bility, as the bullet was fouud on the floor of the saloon the next morning, and was not the least deutod or flat tened. Spocial constable T. M. Ray, who had charge of the prisoner, said that the prisoner had been cut in the hand by some sharp instrument,, about an inch long, and that blood was ou his coat where the hand had been touoh ing. Lucy, who is a . nephew of S. P. Purdy, is well known in Athena. His father, who died in 11)01!, had been a respected and honored citizen of Uma tilla county for many years. He was county judge of this oouuty from 1884 to 1888. Lucy was deputy mar shal and special constable for about u yoar, and whonever any criminals were to be found he always brought hit man, and has served as a very efficient officer. Koletska's livery stable here, says a Sisson, Cal. paper. Groat jagged cracks have opened, from which constant streams of dark colored, oily mud are flowing in great quantities. At about the , same time the upper part of a big fill across Big canyon sank 40 feet This phenomenon occurred at 10 :!10 o'clock Thursday morning. The 1111 across Big canyon was built alnmt six years ago by the Mc Cloud Railway company, and was considered one of the safest Alls on the entire road. The sinking of the fill aud the upheaval at the same time gives ground to much speculation as to the probable cause. Many of the older citizens are in clined to favor tho theory that Mt. Shasta is ou the verge of upheaval. When the mud first began flowing from the lot above the livery stable, Mrs. Koletaku was at the bam alone. She saw that tho mud would flood the town if loft to its own course, so gave the alarm and soon hud men at work digging trenches from the barn to the main sewer ditch. Tho trenches, however, cannot carry the volume of flowing mud and tho streets lielow are gradually filling. Some of the mud was thrown into clear water, and an oily substance soon covered the top of the water, which indicates the presence of much oil.
