That is the way the Binger Hermann jury stood irrevocably deadlock when it was discharged by the court this morning a short timo after 9 o, clock. Those of the jury for convic tion were C. F. Pearson, J. B. Thompson, William Myers, the foreman; Ben F. Skolfield, Friend D. Simmons, Smith Stephens, Henry B. Stone, Charles W. Ris ley, J. C. Smock, Wesley Houck, Alburtus H. Metcalf. George Selkerk stood out for acquittal. Pe held that he could convict the defendant under the law, but not under the evidence, and that his conscience would not permit of his disregarding the one phase of the case for the support of the other. After the discharge of the jury Mr. Heney immediately moved that a new trial be commenced on Monday next, and meeting with the objection of the court that the jury panel had been ex cused until a week from Monday, substituted that date. Here he met with the objection of John M.
