T., for contempt of court. He will re main in Washington territory, pend ing a requisition, which will be had this afternoon. Judge Stearns has removed Holladay from the receiver ship of the Ben Holladay estate, and "Weidler is made sole receiver with orders to earn- out the sale of the property as ordered on the 21st inst tubk's great recuperative powers. BOX 863 New York Novelty Store Thiul St. Astoria, Oregon. last- lie was called to attend James Turk, a sailor boardinghouse keeper under indictment for harboring and secreting sailors from the British hip Lord Canning, and found him to be suffering from chronic al coholism and on the verge of delirium tremens. He concludes his affidavit by alleging that it will be impossible for Turk to appear in court for several days, owing to his phys ical and mental condition. To strengthen this affidavit "F. D. "Win ton, an Astoria lawyer writes the fol lowing letter to district attorney Mc Ginn, and the letter had scarcely been read when Jas. Turk came into the ourt room looking as health as ever: " "Have sent affidavit in case of the state of Oregon vs. .Tames Turk. You will see from that affidavit that Mr. Turk cannot go to Portland for some days, even for arraignment and would like to have some arrangement with you so that Mr. Turk will not have to leave here for several days, until his physician says that he is in a fit condition to go. "Will you kindly consent to let him remain here for say ten days so that he will not be anxious about being compelled to go to court? The doctor says that he should be kept free from all excite ment for some days to come. Turk is on the verge of delirium tremens. There has been given a good bond for his appearance. Officers here know that both parties on bond are financi ally responsible. The sheriff knows that Mrs. Turk owns real property on the roadway near the O. E. & N. Co.'s dock, which" i3 Avorth several thousand dollars. Mr. Dauziger is one of the most solid merchants in town, so that you need not fear but what Turk will be on hand as soon as he can. It will be au accommodation to me also, as our court meets here nest week, although that cuts no figure in my asking that Turk be not troubled now. Yours truly, F. D. Wintojc. Jas. Turk when arraigned showed no signs of being on the verge of de lerium tremens, but rather appeared unusually composed. He was allowed till to-morrow to plead. NEAGIiE RELEASED. San Francisco, Sept. 1G. In the Neagle habeas corpus' case, Judge Sawjer this morning decided that the federal court had jurisdiction in the matter; thafrthe killing of Terry was justifiable, and Neagle was released from custody. A bill of exceptions filed by the counsel for the state was allowed by the court, and pending an appeal to the United States supreme couit, Neagle was ordered released on his own recognizance with bonds fixed at $5,000. THE NEW CRUISER. "BALTIMORE." "Washington, Sept. 1G. Secretary Tracy to-day received the following telegram from Captain Kirkland, president of the trial board which conducted the trial of the new cruiser Baltimore on Saturday: The trial of the Baltimore was sat isfactorily completed to-day. Her horse power is iu excess of the re quirements.
