The New York Herald takes the ground that Behring sea is an open sea for four leasens: First, because geographers have so deflned it; second, because writers on interna tional law have so considered it; third, because England has so regarded it when she protested against the claim set up-by Russia, and fourth, because the United States took a similar view of the Russian claim some fifty odd years ago. In the face of this show ing the Russian government main tained its right of control over its re maining half of the sea up to 1882 against, the world, and the world did not dispute it. In that year an order wa3 issued by the Russian govern ment to the effect that foreign ves sels found trading, hunting, fish ing, etc., in Russian waters (meaning the Russian half of Behring sea) shall be confiscated, both vessel and cargo, for the benefit of the govern ment. There was nothing ambigu ous about this order. It w-s made to apply to everybody of whatever nation who might trespass upon what Russia declared to be Russian waters.
