GO fic gnUtj teiau. ASTORIA. OREGON: WEDNESDAY- -ADGDST 21, 1889. AN INFRACTION OF LAW. Gov. Pexxoyer is a zealous official, quick to resent any infraction of the law. The Astokiak directs in this most public manner, the attention of his excellency to the Democratic Times, a newspaper published at Jacksonville, in this state. In the eighth column, fourth page of the Jacksonville Democratic Times, of date August 15th, 1889, he will find a display advertisement half a column in length, of the Louisiana state lottery. Advertisements of this lot tery are prohibited by law in this state. Such advertisement is an in fraction of law. Governor Pennoyer will receive this copy of The Astobian to-morrow afternoon. He will either do one of two things verify or ignore this charge. Being so earnest an advocate of law it is intensely probable that he will verify it by inspection. Having done so, he will probably deem it his duty to begin the proper legal pro ceedings. The penalty is very plain. The proprietor of our esteemed con temporary is financially responsible. "What are you going to do about it, governor? A farmer in Buena Vista county, Iowa, is plucky. He shipped 300 steers to Chicago, and held them there two days, but could not get what he considered a fair price, so he shipped them back home and began buying more cattle. When he had 700 he shipped them to New York and chartered a steamer for 3,200 and took them to England. He realized a handsome profit on the venture. Pbof. Thurston, of Cornell univer sity, in an article in the North Amer ican Review, expresses the opinion that the steam engine is still capable of vast imprevement: that the next generation will see the American con tinent spanned by flying trains in two days, and that ships of 20,000 tons will be nronelled at the rate of 40 miles an hour. The Concurs Made Them Stop. H. Devol and H. Jeldness went up in the Cascade mountains a wees ago looking for timber land. Last Thurs day night about half past eleven as they crossed a creek a mile and a half from their intended camping ground, they were startled by the yells of cougars. There must have been a whole family of the brutes for the howls came from different directions at the same time. Here the two were at midnight in the heart of the woods far away from any human habitation and without any more formidable weapon than an ax and a pocket knife each. They jumped from their horses, struck matches and made a fire in a few minutes. This stopped the noise and they were no more disturbed during the night. Pobtlwo), Aug. 20. The steamer Mountain Queen was taken to Ash street dock to-day, where her furnish ing was removed. She was stripped clean of everything prior to her being piuceu m me nanas oi tue ouuaers. The work will be begun at once on remodeling her as a side wheeler. TO ARRIVE. Commander George W. Coffin, sec retary of the light house board, and Lieutenant Commander Ehoades, are expected to arrive here about the 22nd of this month. Lieutenant Ehoades succeeds Commander U. S. Sebree as light house inspector of this thir teenth district. . On their arrival they will make a trip on the tender Manza nita. After replacing some buoys in the river she will arrive here on Thursday in readiness "for the pro posed tour of inspection. A CASE SETTLED. The case of "William Basquell against the British ship City of Car lisle was settled this morning, the court allowing plaintiff 1,500 dam ages. The vessel, it will be remem bered, arrived in Portland last March. On her arrival suit was at once com menced. Basquell, who is a boy. had taken passage as an apprentice on the City of Carlisle, bound from Liver pool to Portland. In November of 1888 while at sea as the maintop sail was being furled the boy was struck on the head by what is technically known as a clew iron. The wound was very severe, as subsequent de velopments proved, to the injured boys brain. Basquelle claimed that the accident was caused by the result of carelessness on the part of Captain C.D.Moore, and further that after the accident the captain not only failed to give him proper medical treatment but abused him in a most cruel and heartless manner. In pass ing judgement the court held that in regard to the accident itself both the captain and boy were equally negli gent, but in regard to the charge of cruelty the evidence all went to show that the captain" had treated the boy in a shockingly inhuman manner. Jn the apportionment of damages $200 was allowed for hospital expenses, $300 for medical attendance, $30 for wages, $1,000 for injury sustained. AN OFFICIAL DECISION'. Washington, Aug. 20. The attorney-general has decided that captain Duvergier, who was convicted of kill ing consul Stanwood at Audakabe some time ago, cannot legally be brought to this country to Eervo out his sentence of ten years. There are no means of confining Duvergier at Tamatave, and it was found necessary to take him away from Madagascar to confine him. The attorney-general says he would be liable to release on a writ of habeas corpus if brought here. During former administrations, prisoners sentenced by consular courts in the Ottoman empire were brought to the United States for confinement, but the attorney-general explains that this was done only when the prisoner had been sentenced to death and the president had used his power of mak ing conditional pardon, and commuted the sentence practically that way. In the case of captain Duvergier re course may be had to a similar device, which would result in his con finement in the United States for a term less than ten years, pardon be ing extended for the remainder of the time, thus imposing the necessary condition; but meanwhile officials of the state department are not without apprehensions that the prisoner may by his escape avoid any official solu tion of the problem. The state de partment is much interested in the matterr.as the increasing number of trials and convictions in the consular courts, especially in the islands of the Pacific, where there are limited means for the confinement of prison ers, may render some new rule of law necessary. SECRETARY WINDOM ON CHINESE IUGIIT3. "Washington, Aug. 20. Secretary Windom has written a letter to T. J. Barry of Boston in reply to an in quiry, in which he says that Chinese persons other than laborers may leave and reenter the United States" with out let or hindrance, provided they satisfy the officers of the fact of their not being laborers and of having law5 fully resided in the United States. VERT IMPROBABLE. London, Aug. 17. Cardinal Lavige rie, it is understood, will shortly ap peal in the name of the Holy Father, Leo XDH, to the nations of Europe to purchase from the infidel defilers the Holy City of Jerusalem, and as much of its surroundings as will be necessa ry to form a small province, to be for ever independent and guaranteed its integrity by western powers. If suc cessful, this victory for the cause of civflization, it is considered by the Cardinal and Pope Leo, would be the greatest triumph ever achieved by the Catholic church, would endear it to the affections of -many now alienated from its teaching and prestage, and would do much toward creating a gen eral desire for the restoration of its temporal power. A BOOK TRUST. New York, Aug. 20. It is reported a book trust will be organized with English capital, the 'amount being $10 000,000. The Sun says the plau mapped out is that an English syndi cate shall buy outright the business of the leading publishers of cheap nov els in this city and Chicago. A Sound Kcgal Opinion.
