On the night of March 21, 1887, the dwelling house of Mr. Brower, at Medical lake, worth about 2,500 was burned. The fue was supposed to be the work of an in cendiary. At the time of the fire the house was unoccupied. For some cause Mr. Brower occasioned the arrest of Mrs. Maggie Biower, his divorced wife, charging her with the offense of arson in burn ing the building -A hearing was had before Judge Booge, justice of the peace, at which T. C. Grifitts, Esq., appeared as counsel for de fen dan t and maintained, iraoig other thmp-s that it was not a crime against the laws of the territory to burn an unoccupied dwelling house. The lady was held to bail, however, and on "Wednesday her case came up before the grand jury at Spokane Falls. The jury submitted the point of law to the court, and his honor, Judge Tur ner, instructed them in substance that it was not the crime of arson or any other crime to burn an un occupied dwelling house, and that they should not report a true bill. The announcement of the law cre ated much commeut and surprise. It seems that the statuto relating to arson was amended in 1885-6, and in tho amended statute this state of facts was omitted and not denounced as a crime. From this deoision, which seems to be un questionably tho law, it results that any person may burn an un occupied dwelling house anywhere in this territory with absolute im punity, so far as any punishment therefor is concerned.
