A case of importance to timber claimants in Oregon and "Washing ton territory has just been decided by the supreme court of California. The question at' issue waF, what constitutes timber lands under the meaning of the act of congress providing for the sale of such lands. Following isibe finding of the dis trict court as to the character of land in .question. "The said' Jands are situated in the Santa Cruz mountains, about six miles from the coast, and dif ficult of access for the reason that there are not any roads leading thereto. The surface is rolling and uneven, but not' steep. The soil is of a rich nature, and a greater portion of the surface is oove'red with brush and redwood timber, which must bo removed before the land can be plowed. This would involve a very consid erable outlay. There are spaces and openings, aggregating some what less than one-half, ready to be plowed. The land now has a distinct value for its timber, but when the timber shall have been removed it will be more valuable for agricultural purposes. For these reasons, and none other, the court finds that at the time of the filing of plaintiff's application said lands were and still are suita ble for cultivation." In appealing to the supreme court the plaintiff, who has filed on the tract as timber land, de clared that the court was wholly unwarranted in ruling that because the soil is of a rich nature that the lands are suitable for cultivation, when, as a fact, a greater part of them cannot be plowed until the timber is removed. Plaintiff fur ther declared "that the term Suitable for cultivation,' logicall -and- etymologicaUy, mean pres ently or immediately .fit for tillage without other preparations than appertain. to ordinary operation: of husbandry, and cannot apply to timber lands incapable of cultiva tion until the timber is removed." The supreme court held that they were unable to agree with the plaintiff in the interpretation of this phrase, and, therefore, aflirmcd the decision of the lower court f taking occasion in this connection, to quote from a letter of the sec retary of the interior to Commis sioner "McFarland, wherein the secretary says: "All timber lands are unfit for cultivation inw their natural condition, but it they may be redeemed and made suscepti ble of cultivation by the ordinary farming process they are not, in my opinion, within the purposes of this act, which was intended to embrace within its provisions tim bered tracts only, in broken, rug-g-id or mountainous districts, with soil unfit for ordinary "agricultural purf 03e3 when cleared of tie tim ber." Says the American Magazine, a man's first duties are to bis fam ily and himself. The state should not make those primary duties more difficult by taxing any of the necessaries of life. The necessity for the major portion of tho enor mous revenue needed by govern ment arises from vice and folly in their yarious forms. The causes of taxation should bear the burden of taxation. All public revenues should be drawn from indirect taxes upon conduct and conditions more or less inimical 'to the general welfare. Luxuries, vices, follies, etcesrive wealth, and all conduct,iu either citizens or foreigners, which ten Is to generate evil and injus tice, "should be taxed as far as prac ticable. Such a system of taxa tion would necessarily have & cor relative effect, vi$., the encourage ment of virtuous acts by freeing them from public burdens. In Ete id of-- a policy which would mike it impossible for any indi vidual to ever become the absolute owner of a homestead thal-would iuke mankind morj:-nom&dio and lessen their interest in and affec tion for their homes the state should encourage every man to get a piece of ground and a home of his own. To this end, all home steads to a limited amount of value, should be exempt both from taxation and from attachment for debt. The tendency of such a measure would be silently to pre vent and cure the evil of a monop oly of land by a comparatively few, as well as the evil of a tenant population with little interest in the soil upon which their toil and lives are spent. THE MODERN KNOCKOUT. A Blow That Might Kill a 5Tan or Pat Him to Sleep. The modern prize fight is a knock out It used to be that men would fight 100 rouuds with bare knuckles, while now it is the rule to knook a man out with gloves in a few rounds. It is not that men have less endurance than formerly, for it is not n quostion o endurance. The secret is a blow from the shoulder on the sido of the neck. Such a blow, fairly planted, knocks a man out.' In the modern prize fight it is a question of skill in getting in this neck blow. Occasion ally two men are so equally matched as to skill that neither can get in this blow -until either is too weak to make it effective. In such a fight we have the old contest of endurance. In the majority of recent fights this neck blow does the business in a few rounds. It is not a new discovery, this neck blow. In "Kenelm Chillingly" Bul wer introduces it with wonderful ef fect When the light and trim hero meets a robust thumper, he neatly plants this blow on -his neck, and the big one goes down like a struck ox. But Bulwer warns his readers that it is a very dangerous blow, and may kill a man. The danger in it is one reason why it has been seldom resorted to by fighters. But since the introduction of glove fights they seem to have concluded that there is less risk in it The philosophy of the thing is simple enough, and has nothing to do with the jugular veinB, as fighters imagine. It forces the neck vertebra against the spinal cord, producing temporary paralysis. The danger is in dislocat ing the neck.
