Important Decision. Ad important decision was tendered yestsrday by Judge Bean which may be far reaching in its effects. It was rendered in . the case of the Maxwell Land & Irrigation company against L. W. Furnas. The decision was in favor of the defendant. This case ib the one which was tried before Judge Bean during Christ mas week, the whole of that time being consumed with tha introduc tion of the evidence and the argu ments of the attorneys. The sum of $19,200 was at sUke but in addition tothik it is said that there are a num ber of cases exactly similar which the Mawxell company had contemplated brinigng but which will, now be dropped. All of the intended defend ants were homesteaders on the Uma tilla uroject. The suit was brought by the Max well company to compel the payment of $19,200 alleged to be due for the payment, of water rights, in accord ance with contracts entered into be tween Mr. Furnas and the company. It was tho contention cf the defend ant that the Maxwell company had transferred all its water rights to I tha government and that it had noth j ing to give in exchange for the $19,- l;f rsonally rass on 200 demanded. This contention was D:xr,n is a member upheld by Judge Bean and was the basis of his decision which dismissed the case against Furnas. East Oreeonian. states. Sales this year will be the heaviest yet made from government reserves. Last year sales in the two counties aggregated 130.000,000 feet, board measure.. This year proposals have been made'for the purchase of about 650,000.000 feet. Growing scarcity of timber on private holdings is leading millmen to the reserves for logs This increase is expected to continue for the next few years until the point is reached where only mature timber will be cut. Sturaoage priecs this year changed by the government are about Si. The torestry law provides that 25 per cent of the stumpage revenue, shall go to the state where the forest, is cut. This means that the revenue to the two states for the coming year from timber cut off forest reserve lands will be about $1,200,000. New Feed Store.
