Salem, Ore., June 1. The first rul ing of the supreme court on the ques tion whether the amendment rattl fled by the people in 1910 exempted incorporated towns and cities from the local option law came yesterday. The court decided Incorporated towns and cities were not exempt. Thus the local option law is not invalidated in these cases. The decision came in state vs. Schuler, Wallowa county, in which the defendant was convicted of violating the local option law in Joseph. The Judgment of the lower court is affirm, td. Defendant appealed on the ground that the amendment to the constitu tion, exempted incorporated towns and cities. Judge Moore who wrote the decis ions, said: "Where the county Is dry a vote of the people In towns must be taken before the order of things can be changed. It will be seen that while the legal voters of every city and town are authorized to license or prohibit the sale of liquor therein, the clause making the municipality subj'iet to the local option law with in Its limits, requires an election of voters of the municipality before the sale of liquors enn be legalized where not legalize at the time of the pas sage of the homo rule bill." Judge I'.urnett contends the homo rule bill of no effect because of the phraso "subject to local option law." He takes the stand that the bill leaves conditions as in the first place. But Judge Moore bases his ruling on the additional clause "within its limits" and holds this1 to mean that the 11- I quor iramc is left to the option of oieru or municipalities without out side interference. The clause of the home rule amend ment reads: "The legal voters of every city and town are herby granted power to en act and amend their municipal char ter, subject to the constitution and criminal laws of the state of Oregon, and the exclusive power to license, rt-Kuiuie, control, or to suppress or prohibit the sale of Intoxicating liq uors therein Is vested in such munici pality; but such municipality shall within its limits be subject to the pro visions of the local option law of the state of Oregon." Other decisions yesterday were: State of Oregon vs. Dan Hearn, Jo sephine county, lower court's decis ion affirmed. Defendant was convict ed for violating the local option law and appealed, alleging that Incorpor ated towns and municipalities were exempt from operation of the law. John H. Harter vs. W. H. Cone, Tillamook county, decision of lower court In favor of defendant reversed and case remanded. The suit Involved tax title lands and was a suit for ejectment. C. It. Templeton vs. Cor II P.. Lloyd, Multnomah county, motion to dismiss denied and decision affirmed on mer its. This action Is one for foreclos ure of chattel mortgage on personal property. John i"T. Lnwrey vs. Charles H. IJanna, appealed from Umatilla coun ty. Judgment in tu-.'nr of plaintiff re versed and case dismissed. A res loutlon opposing the re-election of I'nited States Senator Duncan I. Fl"t''her of Florida ns vice president of the American Unitarian association because of his vote In the Lorimer case, received the endorsement of the ministerial union. An attempt was made to place the union, as a body. In opposition to Senator Fletcher, but It wns finally agreed to put the mhtter in a resolu tion which will be laid before the constitutional meeting of the body. The attack upon Senator Fletcher because of his vote on the Lorimer resolution was led by Rev. John Hlnes Holms, pastor of the Church of the Messiah, Xew York City. Mr. Holmes followed his remarks with the presen tation of a resolijion, which wns adopted, stating that the union did not regard Senator Fletcher as elig ible to leadership In the association because of his vote in the Lorimer case. The sect Is especially strong In the Missouri valley and a large number of visitors from Missouri, Kansas, Ne braska and Iowa are here, In addi tion to the official delegates.
