With Judge G. W. Phelps on the bench, the regular January term of the circuit court was convened this morning at 10 o'clock but owing to the disorder attending the change in the offices of circuit judge and dis trict attorney there will not be much accomplished this week. Judge Bean, before retiring, had not Bet the date of hearing for any of the civil cases and consequently no witnesses had been subpoenaed and because of the delay In the appointment of the dis trict attorney, the criminal cases are not yet in readiness. Following is the grand Jury which was drawn immediately after the opening of court: Abner Rugg, fore jnan, Henry Groth, J. B. Gross, Iley Winn, Mark Moorhouse, Dan Shaw and J. A. Martin. In Instructing the Jury before it commenced' its duties. Judge Phelps read the sections relat ing to violations of local option law, libel law- and the law prohibiting prizefighting. The docket was called and several civil cases were dismissed by motion of the attorneys, following which Judge Phelps set the case of Barnes vs. Brown for hearing next Monday morning at 10 o'clock to be followed by the Phillips vs. Harder case. Court then took recess until 1:30 this after noon, when the veniremen were ex cused from further attendance until next Monday morning. The grand Jury, however, will be in session to morrow and will continue its labors throughout the week. MRS EARL DIES AT AGE OP EIGHTY-FIVE Mrs. Lucinda Earl died at the home of her daughter, Mrs. Swanty Ander son, about 6 o'clock this morning, at the age of 85 yea?s. Death was due to a fall sustained about 14 months ago and by which she sustained an Injury to her hip which has confined her to the bed ever since. Mrs. Earl was born In Crawfords ville. Indiana, in October, 1825. She crossed the plains to Oregon In 1851, locating near the present city of Cor vallis. In 1882 she accompanied her husband to this county and has re sided here continuously since that time. Mr. Earl died 11 years ago In this city, but she Is survived by three chil dren, J. P. Earl, Mrs. M. J. Anderson and I. E. Earl. . The deceased was a life-long mem ber of the Methodist church and the funeral services will be conducted by Rev. Nathan Evans, pastor of the Methodist church In this city, at the home of Swanty Anderson, 12 miles south of Pendleton at 10 o'clock to morrow morning. Interment will be in Olney cemetery. "II Newsy Notes of Pendleton IfctnLs to Asylum Site. The deeds to the Oliver tract which was selected as the site for the branch fatylum were received by Reorder Burroughs this morning from the sec- rotary of state. Old Mini to Poor Farm. The county court has committed Dave Nelson a well known resident of ;h!s county to the poor farm. Mr. Nelson is 87 years old and Is extreme ly feeble. Stewart Creek Ranch Sold, John Yasher this afternoon sold his 240 acre ranch on Stewart creek to Julia R. Luhrs for a consideration of $3800. The sale was made through E. T. Wade. Two New Caterpillars. N E. L. Smith, the local agent, has received two new caterpillar engines for rmatilla county farmers. He un loaded them this morning and they were taken through Main street under their own power. Funeral of ClUld. The funeral of Nadine Dupuls, the three year old child of C. F. Dupuls, who died Friday night at St. Anthony's hospital following an operation for gangrene of the intestines, was held from the local Catholic church yes terday afternoon at 2 o'clock. New Comity Physician. The new county court has appoint ed Dr. H. S. Garfield as county phy sician to succeed Dr. W. G. Cole and he will begin his duties immediately. The court was not In session this mor ning owing to the absence of Com missioner Lee who was detained at home by the illness of his daughter. tion and several southern Oregon del egations, In the house and senate, tne state generally elected a large number of assembly republicans. The balance of power between the assembly and anti-assembly republi cans is yet In doubt. Just now the assembly leaders are making every ef fort to elect Jay Bowerman, defeated candidate for governor, as president of the senate, and to elect an assem bly man as speaker of the house. Should the regulars succeed in their efforts, assemblymen probably would be appointed to the Important com mittees and there Is a possibility that they would be able to kill some of the so-called reform legislation y pass ing other bills with an emergency clause attached. Such action would prevent them being defeated later by the people under the referendum. ' West Holds Power. The weak link in the chain, how ever, is that Oswald West will be gov ernor. West was elected on a direct primary, Initiative and referendum platform after a bitter fight. Natur ally very little assembly legislation will get his veto and as the. vote now stands It Is so close that It is Improb able that many measures can be pass ed over his veto. The session probably will be the last stand of the republican party as a closed corporation In Oregon. With in two years Initiative legislation will probably be passed that will enable the voters to elect the speaker of the house and president of the - senate. This will put to rout all rings, assem blies and other efforts at machine or ganization, and Oregon will be In a position to give the theory of direct primary and the fullest possible Ideas of direct government the acid test of practice. Bis Reward Offered. Chief of Police Gurdane is today posting notices received from Mayor Pratt of Spokane offering 17500 re ward for the apprehension of the person who shot and killed Capt. J. F. Sullivan of that city last week. The reward is offered by the Spokane city council. The worst old maid of the bunch Is the male one. WHY THEY FAIL. Most Pile Remedies Miss the Cause of Piles. Con demanding the "white wash" of Lori mer, Senator Owen of Oklahoma, op ened war on the Illinois senator to day and introduced a resolution de claring that Loriraer's election was Illegal and void. It will serve, when the final vote is taken, to place the members of the senate on record. In his speech on the floor , Owen said he could not acquiesce In the conclusions of the investigating com Club Will Meet. The members of the Thursday Af ternoon club will hold their regular meeting next Thursday, January 12, at the home of Mrs. W. A. Slusher, with Mrs. Alice Sheridan hostess. Mrs. Stephen A. Lowell will be hostess on January 19, instead of the 12th as per club calendar. Sunday Was Dry Day. There were no attempts to violate the provisions of the ordinance which prohibits the sale of liquor on Sun Jay yesterday, according to Chief of Police Gurdane. In several Instances, however, he was called upon to ac company the owner of a saloon to his place of business In orderx that the latter could enter. RAIN DALGES AIR SHIPS IN FRISCO San Francisco, Jan. 9. Rain today not only put a stop to the aviation meet here but entailed serious loss to aviators through damage by moisture to their machines. More than a dozen aeroplanes were ex posed for hours in a leaky open-ended hangars and suffered badly loosened Joints where glue instead of bolts were used. The wings were most badly af fected. Glen Curtis' standard machine was ruined. Brooklns and Parmales' Standard and Baby Wright racers suf fered a similar fate. Latham and Radley were the most fortunate but they spent most of the time today wiping off pools of water on their wings. There nvill be no further i flights until the weather clears. The New Boston Store VACANCY EXISTS IN HIGH SCHOOL FACULTY PRESIDENT DIAZ FIRES MEMBERS OF COURT Beveridge Also. Washington, D.,C Jan. 9. Senator Beveridge today Introduced resolu tions declaring Senator Lorimer was not elected rightfully to the senate. The resolution was handed In with the minority report of the findings of the investigating committee. The re port elaborately reviewed the find ings of the committee's majority and says: "The majority report Itself de clares that four members of the gen eral Illinois assembly testified they had received a money consideration for their votes." He says this was not disputed and therefore can not un derstand why he has a right to the seat. Improving Hotel Lobby. At the Hotel St. George carpenters are at work today tearing out a par tition directly In the rear of the coun ter. Now that he has moved his bar to the old restaurant room Mr. Dar veau will enlarge the hotel lobby by moving the partition back some 20 feet. General Cozio has resigned as minister of war. Min ister of Finance Limantour has sig nified his intention of retiring and other members of President Diaz's cabinet will be changed as a result of the poor showing being made by the government against the revolutionists, it is reported. Cozio withdrew after a lonit conference with Diaz. It Is reported he was severely criticized because the revolutionary movement had not been stampede out. It Is expected that Enrique Creel, former minister to the United States will succeed Cozio. There is another vacancy In the fac ulty of the high school, Prof. M. S. Pate having resigned his position as instructor In the agricultural depart ment to accept the superlntendency of the Athena public schools. Prof. Pate has only been on the local faculty since the beginning of the fall term but during his service has given such satisfaction that when Superintendent C. C. Baker of Athena, was compelled to resgn on account of the serious ill ness of his wife, he was called to fill the vacancy. Mrs. Pate had previous ly secured a position in the Athena schools and both commenced their new duties this morning. As yet no one has been elected to fill the vacancy caused by Prof. Pate's resignation, but Superintendent Land ers stated this morning that an effort Is now being made to secure a thor ough agriculture man from the Ore gon agricultural college or from Wash rngton state college, failing in which the board would get Into communica tion wth some eastern agrcultural col lege, Ernest Wells, assistant prlncl pal of Athena high school, was strong' DEFENDERS WIN IN RIG NAVAL WAR GAME Washington. D. C Jan. 9. After a seven-day game of hide and seek the seven scout cruisers, constituting the "defenders" scored a victory to day over the 16 battleships of the at tacking fleet In the naval game. A wireless from Rear Admir.il Stanton, commanding the defenders, to the navy department today, said tho bat tleshins were Intercepted enroute to Guantanamo. This is equivalent to Seven Drunks In Court. Seven men were brought before Judge Fitz Gerald this morning to answer to charges of being drunk. Thoy j?ave their names as Jack Ben nett, Frank Wlndom, E. Cudless, John Anderson, Xell McDennet, Arthur Hill and W. E. Harbert. They all pleaded guilty and were given the option of three days in Jail or a five dollar fine. McDennett was the only one to put up the cash and the rest are now serving out their time. The First National Bank of Elm Grove was robbed of 112,689 some time Saturday or Sunday. The thieves entered, secured the money and eg' caped. Martin must go to trial today, charged with the murder of her daughter, Mrs. Ocey Wardlaw Martin Snead, the young woman who was found dead in a bath' tub In an East Orange house over year ago. . Mrs. Mary W. Snead, mother-in-law of the dead young wo man, ls also waiting trial for compile ity In the crime. Miss Virginia Ward' law, aunt of the bathtub victim, was also arrested, but died while awaiting trial.
