Assistant Attorney-General Van Klnldo, however, iiRur a perusal or tho hill, gavo It as his opinion that tho measure applies only to widows who are residents of the stato when It heroines effective, and to Hiich who come within Its purview after wards, and that it Is not retro actlvo. The section In question reads: , "This act shall apply only to wo men who nro residents of this slnte nt the time this act Is passed, oi who wore residents of the state at tho time of tho oecurronro of the events which entltlo thorn to the benefits of this net provided by sec tion 1." If technically constructed the mensuro would seom only to apply to widows who aro residents when It becomes effective or who wero residents prior thereto, and that It should not ho applicable to widows who might becomo resldouts of the state after Its pnssago. Tho Assist ant Attomoy Gcnernl, however, does not bellevo thnt such a construc tion would carry out tho intent of tho measure. Ho Is of tho opinion that tho word "wero" wns used un advisedly, and thnt It was intended to convey the same meaning as tho words "shall be," and that If n court1 were called upon to construo the bill, It wotdd so Interpret It. Under such an Interpretation the mensuro would not bo retroactive, but would apply only to widows who aro residents of tho state at tho tlmo It becomes effective, or who mny becomo residents of the state aftorwardn, and otherwise como within Its purview, and that, he be lieves, was the Intent of tho law makers who passed It.
