Strang vs. tho McDonald & Yaughnu Logging Compnny. Into Saturday night brought In a verdict for tho plaintiff for $:100. Mr. Strnng was suing for $t 2.000 damages. Ho lost a linger, whllo coupling cars on tho logging company's railroad, tho Injury badly affecting his hand. Tho enso was of special Interest because it was tho llrst one tried hero under tho 1911 Kmployors' Lia bility law, a matter on which tho Oregon supremo court has not yet passed. Consequently the attorneys In the case and Judge Coko had to, so to speak, do considerable pioneer lug. Strang maintained that tho com pany had not equipped their ears with tho new automatic safety coup ler, but wero using the old Lincoln pin coupler, and that consequently tho accident was duo to tho nogll- gence of tho company. The defonse set up that tho pin coupler was bet ter for logging trains than the au tomatic coupler and that Strang had beon Instructed to uso a stick Instead of his hand In placing tho links. Judge Coko In his Instructions to tho Jury held that under tho new law tho companies had discretion In the matter but must furnish tho sa fer and olllclout equipment nlthoiiKh It might not bo as elllclent as other equipment they desired. Ho also ruled that contributory negligence on the part of the employe was not a defense and could only be taken Into consideration by the Jury In llxlug tho amount of damages. Heretofore, contributory negligence has been a defense In personal Injury cases. The new law places tho burden on tho employer and con sequently tho outcome of the Strang caso was closely watched. The $:I00 damages allowed U about the wogos Strang would have ordi narily oarueil during tho tlmo ho was laid up by the accident. Owing to tho small damages al lowed, it Is possible that tho case may not be appealed. Today, tho case of Randall vs. tho t A.
