E. DIx has returned from Coquille where he was called yesterday by a logger named Davenport sustaining a fractured skull In an accident at tho Smith-Powers camp on Cunning ham Creek. Davenport was brought to Mercy hospital at North Bend. Many Enjoy Concert The open air concert given by tho Marshfleld band yesterday afternoon at the City Park -was largely atended and proved more than pleasing to those assembl ed. The various numbers were well rendered and Director Fenton, Man ager J. Albert Matson and the mem bers of tho organization received much praise. The business men gen erally have subscribed liberally to wards the maintenance of the band. I W HIT MRS. C. B. SELBY expects to leave soon for California and southern points. MRS. Smith company has in stituted suit in tho federal court at Portland against the Coos Bay, Rose bur's & Eastern Railway and Naviga tion Co. to secure possession of an undivided 10-32 Interest In the water front of what Is known as tho Rail road Reserve extending from tho mouth of Mill Slough south beyond the railroad docks. The property is vajjjed.. nt ..between, ,?100,QQQ and 150,000. , -The suit promises to bo one that will be bitterly fought lit the courts. The railroad company lias been In possession of the tract since tho lino was, built in the early 90s while the C. EX. Smith Co. through its subsidi- ary;corporation claims to have n per fect' title to the interest In question through its purchase of tho E. B. Deiin and company holdings. The railroad company's coal bunker and freight warehouse are located on the strip but they have not occupied It long enough to" 'establish ownership through adverse possession. According to the claims of the C. A. Smith company, When the E. B. Dean and company granted as part of the bonus for the building of the line certain tracts in South Marsh fleld, E. B. Dean did not sign the deed granting tho water front prop erty in contentldn. As he held a 10-32 interest In tho company, the Smith company which purchased his holdings claim that undivided Inter est In It. The Farmers Loan and Trust company of New York is made a Joint defendant with the railroad company, It having been the dond holders of the local road when it was built and having takon it from R. A. Graham through a foreclosure. While their Interest In it was thought to have been wound, up gy W. S. Chand ler as receiver of tho line some years ago, tho records are not clear and In order to cover any possible defect, the trust company is named as one of tho defendants in tho petition. WARD BLAKE who was called east by the death of his mother return ed on the Nann Smith Saturday. He was accompanied home by Mrs. Blake. J. D. JOHNSON returned Friday from an extended sojourn in Southern California. He is look ing much Improved in health and is kept busy greeting his many friends. W. F. McKEE will leave Wednesday for Great Falls, Mont., to accept a position as general auditor of the telephone companies of which R. T. Durrett, formerly of Coos Bay, Is manager. H. G. Tho meet started at about 2:30 with the relay which was close all tho way through, tho Purple winning by a couple of feet. Torrey, Mer chant, S. Clarko and Stutsman ran for tho Purple and "Welder, Hennes sey, Horton and Harrington were on the Gold. Tho time was 1:4S. Mr. Sether Is one of the owners of tho Cooston Town slto company and It is understood they nro negotiating for tho sale of the property or an Interest in It. Mr. Johnson Is looking for timber lands. MR. and MRS. L. J. SIMPSON nnd J. R. Smith of North Bond return ed yesterday from an extended busluess and pleasure trip to San Francisco and Portland. They came by private convoyanco from Rosoburg via old Coos Bay wagon road leaving Roseburg at 9 o'clock Saturday morning nnd reaching Sumner at 3 p. m. Sunday. They report tho road In fair condition. Hencoforth she will leavo Marshflold at 4 o'clock in tho after noon for tho head of navigation on South Coos River and returning will reach Marshfleld at 8:30 In tho morning.
