K ELLERBY STILL ABSENT Empire Woman Fails to Ap pear to Answer In dictment. (Special to The Tlme3.) COQUILLE, Ore., Sept 14. Mrs. Jack Ellerby of Empire, has not yet appeared in circuit court to answer the Indictment for which she was to have appeared yesterday. She is not at Empire and did not return on the M. F. Plant, Another report current here today was to the effect that she went to Seattle. The ?500 bond, furnished by L. A. Trey of North Bend, is understood to have been settled and Mr. Frey reimburs ed. Circuit court is busy. The Ten Mile Liquor cases were brought up this morning but Judge Coke has re served his sentence in the cases of Chas. Norls and Mr. Miietzel. Chas. McCulloch Is understood to have furnished the state the evidence against tho in. Today, the suit of F. K. Gettlns vs. Patrick Hennessey of Marshfleld, is being heard. It is an echo of the Knuppenberg manipulations on the Bay. Gettlns was hired by Knup penberg to do surveying on the O. C. & N. property which he (Knup penberg) claimed he had bought. The deal fell through and Mr. Get tlns never got his money. Now Mr. Gettlns seeks to recover from Mr. Hennessey, alleging that Mr. Hen nessey was a partner of Knuppen berg.
