The case of Mike Hart and wife vs. George Con- dy and wife, taken on a writ of re view from Justice Pennock's court to the Circuit court by C. F. Mc-r Knight, was decided yesterday at Co qullle In favor of the plaintiffs. The original suit was entitled George Condy and wife vs. Hart and wife, Justice Pennock deciding adversely to the defendants The circuit court reversed his decision. Tho Portland Telegram says: "Fred Krlbs, timber king, has just returned from a two weeks, auto mobile trip through portions of Crook, Grant, Harney, and Malheur counties, with a party of Michigan timber operators who are supposed to bo closely identified with tho Smith Company at Coos Bay. The principal belts of yellow pine In these counties were looked 'over, and It Is understood that negotiations will soon bo conducted for the sale of vast areas of timber In tho region visited. At a meeting of tho Coos Bay Port Commission In the office of the' sec retary. Henry Sengstacken, In Marshfield yesterday afternoon',' '" It was decided that the constitutionality of the port law should be tested In a friendly suit before any formal business Is taken up under It. This is a precautionary step. The commis sioners simply anticipated what would be required If they should at tempt to float a bond issue, pur chasers requiring that all questions of validity be settled before they will take tho bonds. As tho commis sion will have no funds from taxa tion to defray tb'j expense of any harbor Improvement before another year elapses, a iv project taken up would have to oc paid for by thj sale of bonds. By starting the action promptly, It is believed that It can be heard In tho circuit cour1, at tho June term and then Immediately appea.ed to the Supreme Court and a final decl fion secured "within possibly ninety days. v Another meet'ng of the commis sion will be held next Wednesday to make the final preparations for the test suit.
