Yesterday and this morning there Was a lively scramble among tho city officials to ascertain whether Robert Marsden was violating any ordinance in erecting a frame ware house in tho rear of tho C. A. Johnson furniture store, which will take up piactically all of tho dock. Marshal Carter told Mr. Marsden that ho should cease Work until ho secured a permit from the city coun cil, but Mr. Marsden could not bo prevailed upon to cease as ho could not bo shown that ho was violating nny ordinance. Councilman Nolson esterday aft ernoon appealed to several city of ficials to have tho proposed building stopped, but In vain. Marshal Car ter laid tho matter before Mayor Straw and City Engineer S.indborg but they did not do anything. This morning, City Engineer Sandberg loft word for Marshal Carter to have tho work stopped hut ho could not. City Attorney Fnrrln and Hoc order Upton aro out of town and as to whether Mr. Mnrsden Is violating nny ordlnanco or not could not be ascertained. It was tho intention of tho city council to have tho water front cleaned up and a wl'do stieot or thoroughfaio loft alopg tho outer odgo of tho dock but whethor they protected themselves or not had not been ascertained today. The mattor will probably he made n special matter of business at to night's mooting of tho city council.
