Fred Muetzel, the proprietor of the Ten Mile sawmill was yesterday bound over to the Coos county grand jury by Justice C. L. Pennock on tho charge of assault with intent to kill which was preferred by Albert Smith, an employe of Muetzel's. Muetzel's bond was fixed at $200. PYosecutlng Attorney L. A. Llljeq vlstiirotested against the small bond flxe,d, claiming that the severity of the charge was such that a much larger sum be fixed. Justice Pen nock would not agree. Mr. Llljeqvist left last evening for Ten Mile to investigate the charges against Tom Haggerty who will be arraigned in a few days for alleged thefts committed at Ten Mile, and while there may Investigate the rumors of ill-treatment by Muetzel of his wife. If the stories are sub stantiated by evidence, Mr. Llljeq vist may prefer additional charges against Muetzel. Muetzel in his testimony yester day afternoon did not deny having drawn a revolver and fired a shot, but he claimed that he drew the gun in self defense. He testified that Smith had made threats against him and had broken a beer bottle across his (Muetzel's) leg. He said that when he fired the revolver to frighten Smith, he shot into the air. Smith told a different story and some witnesses of the affair rather substantiated Smith's story. The grand jury will meet at Co qullle Juno 21, and the whole matter will be laid before that body.
