If this statute was strinctly com plied with, it seldom ought to occur that a man should be arrested and the expense of a preliminary exami nation incurred, who cauld not be convicted on final trial in the circuit court. It matters not whether all or Sany of them would be convicted so far as the point under consideration is concerned, but when our code pro vides that officers whose duty it is to administer the laws shall do certain' things, they should rot neglect them; especially when such provision is onej calculated to protect the public treas y. We call special attention, to all who may be interested in this subject that the statute of which we claim alias been violated so long and all over the state does not say that the magistrate may take the depositions of witnesses before he issues a war rant, thus leaving it what might seem somewhat to his niscretion as to whether he shall take them or not.
