Y V MARSHALL FIELD 30 OPENS WILL ATTACK Captain Seeks Control of $125,000,000. FUND TIED UP FOR YEARS Suit in Superior Court of Illinois I'ricndly, but to Be Ar - Sued to 12iil. CHICAGO, May 13. (Special.) Captain Marshall Field this week started an attack on the $125,000,000 w ill of his grandfather. Marshall Field, Supported by Attorneys J. B. Stanch field and Walter II. Pollock of New Tork, the action is before Judge Foell in the superior court. The trustees, executors and bankers who are ad ministerins? the huge estate are rep resented by a half score of lawyers. Touug Marshall Field demands that the residuary trust, estimated at 1125,000,000 bo set asida and that ho be declared absolute in control of the property. Mr. Stanchfield. in outlining: the Is sue, told the court that the will was "one of the most extraordinary schemes in the history of the world's finance for tying up property." "It prescribed a system of entail In violation of law. He estimated that the estate woQld be valued at more than $450,000,000 when the trust ex pired. Under conceivable conditions, it might reach one billion dollars," he said. The trust does not expire until 1956. ''Extraordinary Scheme" Alleged. "A most cursory reading of the will before this court demonstrates "an ex traordinary scheme for tying up prop erty and the accumulation of money never before equaled in Old Kngland or in New linglaud," declared Attor ney Stanchfield. "During the life thus far of the residuary trust, 14 years, no money in the way of income has ever been al lowed to vescape. Marshall Field, now 26 years old, has never received from this residuary estate any income. "When his grandfather determined to make some testamentary disposi tion of his property it is presumable that he knew the laws of Illinois. He must have known if there were any laws in Illinois against the tying up of property. Had the will been pre pared in 1S07, it could not have con tained some of the provisions that it contained." Legislation la Quoted. Mr. Stanchfield referred here to leg islation following close upon the drawing' of the Field will prohibiting the very kind of tying up of large es tates which his "extra-ordinary scheme" provided. The action before the court is four fold. Instituted by the Merchants Loan & Trust company, Chauncey Keep, Ar thur B. Jones and Captain Field, who as trustees of the residuary estate merely asked the court to approve their accounts, the original bill was followed by a cross-bill by Captain Field asking the court to construe the 20th clause and to hold that the trust created by it is void and that . he should receive the entire residuary estate. Entering Into the suit, which is friendly in its nature, although it will be earnestly argued, as a claim of Mrs. Nancy Perkins Field Tree, the widow of Henry Field recently mar ried to Tree. In an answer to the cross bill she sets forth that, as the widow of Henry Field, she is entitled to a dower interest in his portion of the residuary estate. Name Marshall Liked. Attorney Stanchfield intimated that the reason why Marshall Field 3d was favored with the largest resi duary bequest under the will was be cause of the merchant's personal lik ing for the name Marshall. Captain Field, the first witness, identified the will and testified he was a son of Marshall Field 2d and a grandson of the testator. He was born 26 years ago and is married. He had one brother, Henry Field, who is dead, and one sister, Gwendolyn Field. His mother, Mrs. Malvin Drura mond, died last year. She inherited one-third of $5,000,000. His brother inherited one-third of $5,000,000 and one-third of the residuary estate. On his brother's death the witness, who inherited two-thirds of the residuary estate, now inherited, with his chil dren, all of it. Mrs. Henry Field's claim as a widow must be ruled upon by the court. "Did your brother contract any marriage other than that to Nancy Perkins?" "He did not," said Cap tain Field. This question is put to attack the claim of Henry AnUny Marsh, son of Henry Field, and queen of the chorus. Teggy Marsh. Miss Marsh took J100.000 in sum for her claim, but her lawyers contend that her son has a substantial claim. The boy was represented in court by his guardian, Edward F. Dunne, former governor. A supreme court ruling may possibly divide the residuary eslate between the boy and Marshal Field 3d. - , BIG AUDITORIUM ASSURED Bond Issue of $125,000 Is Voted at - The Dulles. ' THE DALLES, Or.. May 13. (Spe cial.) The Dalles will build a civic auditorium at a cost of $125,000. This was decided yesterday, when citizens went to the polls and gave the prolect a majority of 154 voles. Six hundred and twenty-four votes were cast. General obligation bonds to the ex tent of $50,000 also were voted. The bonds carried by a majority of 2S5. While considerable opposition to the auditorium bond issue developed, the valiant work of the American Legion, which is strongly behind the proposition to give music, literature and art a home in this city, carried the project over by'a safe margin. R0TARIANSGET CHARTERS Clubs at Aberdeen and lloquiani Inaugurated by Visitors. ABERDEEN, Wash., May 13. (Spe cial.) Forty-five Rotarians from Se attle, Tacoma and Everett arrived to day to celcbra'te the presentation of charters to the Aberdeen and Hoqulam Rotary clubs. Fifteen more, headed by President Titus, came from Cen- iraua. The Hoquiam charter was presented to officers of the club at noon at a luncheon at the Hotel Grayport. Visit ing rotarians and the Aberdeen club members attended. The Aberdeen charter was delivered to officers of the local club at a dinner tonight at the Hotel Washington. Rev. Thompson Banqueted. CENTRALIA. Wash., May 13. (Spe cial.) Kev. H- !W. Thompson, who left yesterday for Retell, Wash., to assume hia duties as commander of the soldiers' home, was an honor guest Tuesday night at a dinner served by members of the Grant Hodge post, American Legion. The event was a token of appreciation of Mr. Thompson's 'efforts on behalf of the post immediately following the Armistice day tragedy, when, with H. E. Veness, he toured the north west, peaking on Americanization and giving a true version of the mas sacre of ex-service men. . BLAST KILLS LAB OR EH Premature explosion Believed to Have Caused Stan's Death. ABERDEEN, Wash., May 13. (Spe cial.) Carl Werner Lundeen, a resi dent of Aberdeen for the past 15 years, and employed as power man on road construction work on North river, about 12 miles from Aberdeen, was killed yes'terday when a blast he had set exploded prematurely. Though the explosion was heard by other workers no attention was given it and the body was not found until late in the afternoon. Eugene Engages Teachers. EUGENE. Or., May 13. (Special.) Eight new teachers were engaged for the grade schools last night. W. R. Kutherford. city superintendent. said that 38 out of a corps of 48 have I signed contracts and that they are ! either graduates of normal schools or colleges and universities. Very few of the grade teachers now em ployed here have been engaged, as most of them signed an agreement notto serve another year if Super intendent Kutherford is retained. Highway Contract to Be Let. STEVENSON, Wash.. May 13.- (Special.) Highway engineers are! surveying government elide, five miles west of here on the north bank highway, for the purpose of letting a contract for construction of the high way at this point up to standard specifications.
