MOST MONEY RECOVERED Attorney for Aurora Bank Says ire Is Xot in Favor or Pressing Any Action. Charges aRainst Mrs. Emma Wini free, 23-year-old divorcee, and her former husband, P. W. Winifree, now under arrest in connection with the theft of f6500 in currency from the Aurora State b,ank probably will not be pressed, according to announcement made last night by Grant B. Dimick of Oregon City, attorney for the bank. I The question of prosecution has I been left to Mr. Dimick by officers i of the bank, but Mr. Dimick said he ! was not ready to make a definite an nouncement as to the action to be taken until he had conferred with the directors. Personally, however, he said he was not in favor of the prosecution, now that the big ma jority of the money had been re covered. Buried Money Found. Mr. Winifree was taken to his farm near Bull Run yesterday by Burns operatives who have been working on the case and the J1500 which he said was buried in the cellar, there was re covered. This, with the $3000 recov ered on Winifree at the time of his arrest, and the recovery of the $1500 paid on the 14-acre farm on the Base Line road by the couple makes a total of $6000 recovered. Bank officials say the total' loss to the bank probably will be $400 or $500 when the matter is finally ad justed. Mrs. Winifree is being held at the home of Sheriff Wilson at Oregon City and Winifree is at the Clacka mas county jail. Bolh have expressed the desire to have the matter cleared up and to assist the authorities. In discussing the case yesterday Mr. Dimick said there was a question In his mind if the man could he held responsible in any way for the theft. He also said he questioned if any pood would come of punishing th woman for the crime. "After a conference with directors of the bank tomorrow I will be in a position to announce just what steps will be taken in the matter," he said. Orielnal Story Held To. Mr. Dimick said that Winifree held to his original story that he did not know where his former wife got the money. "I am inclined to believe him," he said, "as he has been perfectly frank with us in other matters. Of course he must have had a strong suspicion that everything was not just right." Dr. B. F. Giesy, president of the bank, said that Mrs. Winifree was given employment at the bank tem porarily more as a matter of pity than for ary other reason. "She had Just come out of the hos pital at that time and was in need of employment," he said. "She ap peared to us a nice, innocent girl in need of assistance." Dr. Giesy said 4hat. Mrs. Winifree was III for a tim while" she was visiting at Aurora, suffering from an attack of the grippe. The two daughters of Mr. and Mrs. Winifree are being taken care of at the home of A. Haneberg, a neighbor living near Bull Run. O F Vt CEBS INVESTIGATE District Attorney and Sheriff Have No Report of. Robbery. SALEM, Or., March 11. (Special.) Max Gehlhar, district attorney of Marion county, today started an in vestigation of the case involving Mrs. Kmma Winifree, who is being de tained in jail in Portland on a charge of stealing approximately $6500 from the Aurora State bank. Although Aurora is located in Marion county, District Attorney Gehlhar stated this afternoon that neither the officials of the depository nor the arresting officers had made any report of the alleged theft to his office. Because of this apparent in difference on the part of the persons responsible for Mrs. Winifree's arrest Mr. Gehlhar said he intended to com municate with the Portland officers and ascertain the facts connected with the alleged robbery. Should the findings of the district attorney be such as reported in the Portland newspapers it is not im probable that Sirs. Winifree will be brought to Salem and held for inves tigation before the grand jury, ac cording to Mr. Gehlhar. Mr. Gehlhar says it is customary in cases of this character to report the facts to his office, and especially when the crime was committed in Marion county, and is said to involve the taking of a large sum of money. Sheriff Needham says he also was Ignorant that the Aurora bank' had been robbed until he read a purported statement of the facts in the Fortland press. Should the Marion county officials decide to transfer Mrs. Winifree to this city for investigation her case probably would be laid before the grand jury, which convenes here next Monday. WIFE CRUEL, SAYS HILL Ex-Lawmaker Tells of Several Blows Inflicted by Spouse. ALBANY, Or., March ll.-(Special.) Verd Hill of Independence, former representative in the legislature from Polk county, filed an answer in the state circuit court here yesterday in the case instituted by his wife, Fran ces G. Hill, for a divorce. He opposes his wife's demand for large alimony and asks for the decree and custody of their one child. Mr. Hill alleges that within a few hours after they were married in 1914 ehe demanded a check book on his bank account. He says she told him that now that he had ber it' would .ke a lot to keep ber. Mr. Hill al leges that one night when he went to sleep during a period of denunciation his wife jumped from her bed, went to the one he was occupying, and struck him several times. Mr. Sherlock is now on his way to New Zealand to dispose of the old home property. After a short visit there he will return to Gooselake to spend his remaining days. Forest Salary liaise Pledged.
