Proceedings to dissolve the Linnton Bowllns Club. a corporation, and to close the "Hut" will bo begun at onca by Attorney-General Crawford, It was .announced last night by Sheriff Word, after he returned from Salem, where he had been In conference with Governor "West regarding conditions in Multno mah County. "Governor West has directed the Attorney-General to begin the proper le arai proceedings immediately," Bald the Sheriff. "The incorporation of the property there Is only a fraud to cover up the real purpose of the club." Sheriff Word announced also that ont of the gambling cases, in which de fendants have been dismissed by the District Judges, would be heard by Judge McGinn of the Circuit Court as soon as that Jurist returns from his California trip. Bheriff Word said last right the Judge would be back and ready to hear one of the gambling cases tomorrow. Special Prueestor Named. The case heard by Judge McGinn will tie prosecuted by Peputy District At torney Roblson, who was appointed special representative of, Governor West, following a conference yesterday between the Governor and District At torney Evans. The District Judges, against whose rulings the Sheriff and Governor have taken exception, say that they have in terpreted the law Jairly. "All the gambling cases that liave been brought before us," said Judge Dayton last night, "have been cases in which proprietors of saloons have been charged with conducting a gambling house. The evidence, which has been almost identical in all the cases, has not been sufficient to hold the defendants to the grand Jury. Whether the card players, who have admitted that they were playing for the drinks, were gam bling has never been at issue and the evidence has never been sufficient to show that the proprietors were guilty of conducting any gambling games. The next time a case is brought be fore one of us I, as presiding Judge, am noing to ask all three Judges to sit en banc on the case." Mr. Rohlpon nisngreea. Deputy District Attorney Robison, who has handled most of the cases against the saloonmen arrested in Sheriff Word's raids on the North End places, says the District Judges have Interpreted the law wrong. "If the men who are sitting at the tables playing cards for drinks are gambling, then the saloonman who per mits them to play such a game is guilty of conducting a. gambling game," he said. It was intimated at first that the new law, which gives the Governor au thority to replace Justices of the peace he has reason to "believe- have neg lected their work would be Invoked by Governor West in his effort to as sist Sheriff Word in his war on the gambling games In Portland. Governor West, it is said, has been told, how ever, that there Is grave doubt whether the law would apply in the case of district Judges. J. J. Russell, manager of the Cabaret rrill and saloon, and Rhode & Rupert, who conduct the old Blazier place, on Burnsida street, were dismissed again yesterday by Judge Jones on a gam bling charge, the same evidence being introduced as on the previous charges. Judge Jones announced that ha in tended to protect himself in the mat ter as much as possible, and had a stenographer in court yesterday to take down the evidence. "I believe I am right in the rulings T have made," he said, "and elievins that 1 am right I cannot rule any other way." GOVERNOR'S PLAJf IS'OT MADE Action Against Multnomah Judges Only Discussed, He Says, SALEM, Or. Jan. U. (Special.) After a conference with Sheriff Word, of Multnomah County, regarding an al leged failure of District Judges Jones, Bell and Dayton to enforce laws against saloonkeepers looking to their removal from office. Governor West said tonight that nothing definite had been decided upon. The Governor said it was at first thought he could have the facts laid before Circuit Judge McGinn to deter mine whether the men should be re moved, but the law abolishing the Justices of peace in Portland and creat ing district Judges rendered the old procedure for removal Invalid. Mr. West said that he and the Sheriff talked over plans for a better enforce ment of law in Multnomah County, but had not decided upon anything they wished to make public. CHARTER. ORDERED AXXUDljED Governor Charges Linnton Club Is Organized for Unlawful Purpose. SALEM, Or., Jan. IS. (Special. ) Announcing that the Unnton Bowling Club had been organised for an un lawful purpose. Governor West today asked Attorney-General Crawford to annul its charter in accordance with the provisions of section 384, Lord's Oregon Laws, The Governor said that he had been Informed by the Sheriff of Multnomah County that he would furnish evidence regarding the alleged unlawful oper ations of the club. Acoording to the Governor's information, the club is be ing conducted as a roadhouse. CITY AUDITOR DEFENDANT Judge Gatens Allows Temporary nv fttraintng Order In Case. Suit was filed yesterday against City Auditor Barbur to restrain him from filing; the referendum petition against the franchise granted by the City Council to the Portland & Oregon City Railway Company and to restrain the city official from placing; the issue on the ballot. to be voted on at the next city election.
