Act of AVr Avoided. It has been suggested in some quar ters that to land troops in Mexico would be such an act of war as can be justified only with the approval of Congress. To meet the constitutional objection. In case the transports were sent to Vera Cruz, It is understood that the commanding officers would be in structed not to land troops, except on Congressional authorization. Their presence on the coast, it is felt, doubt less wonld hae a strong moral effect upon the contending factions in Mex ico, and more than a week's time would be tared in placing- the soldiers just where they would be needed In case danger to foreign lives and property should become more Imminent. Americans Irsjed to Move. Unless one side or the other achieves a decisive victory in the City of Mexico within the next day or two, it Is prob able that Ambassador Wilson will be Instructed to try to induce tho Amer ican residents of the capital to go to the ports or other places of safety, and the representatives of other foreign rations are expected to do the same. Several stories of robbery and looting by small mobs were reported today, but for the most part the criminal as well as the law-abiding- element were too terrified by the incidents of tho last two days ti do anything but seek places of safe ty. Business houses, banks and res taurants arc closed and not even a railway ticket is to be bought in the uptown offices. The offices of the cable company have been kept open throughout the fighting, however, even when the shrapnel was beating In on all sides. When a shell tore a gaping hole in the iron shutters over the windows, the force of Mexican operators continued without Interrupting their work of re ceiving and sending at tables not five feet away. Shell Burnt In Apartment-House. The residents of Gore Court evac uated only after two shells had burst into thu big apartment-house. In the Alameda. the great wooded park In the center of the city, the trees were moved down by the vicious lire: small twigs and limbs cover the ground in places, evidence of the heaviness of the small arm fire. Among the buildings damaged was that of the Mutual Life Insurance Company, in the side of which a great hole was torn. Over the building dur ing the battle the British and Amer ican flags were flying. Most of the buildings suffering the greatest dam age are owned by Mexicans, but many offices in them are occupied by Amer icans and other foreigners. Rebel Cannoneers Expert, Considerable damage was done to lae National Theater, now under con struction. It was at this point that the rebels dismounted a federal can non. Another, five squares below, also was dismounted, as were others to the northwest. This evidence of expert marksman ship on the part of tho gunners In the rebel ranks further was demonstrated in the sweeping shrapnel tire over the higher buildings in the center of the city. These operations were Intended t free the district from troublesome riflemen and machine guns. Ono sec tion of these were in the tower of tiie sixth police station; a few blocks fur ther east the Gore office building was used for the same purpose, while other structures within the same area har bored little quick-firers. WARNING IS ISSUED Ambassador Wilson Reports Danger to Americans. DISPATCHES ALARM KNOX Battleship Vermont on Way. CAIMANKRA, Cuba, Fb. 11'. Feb. 12.-Alt)iou&h Mrs. George K Jones, a wealthy wo man SO years old, was blown out of her bed last nlfrht by a dynamite 'ex plosion which wrecked her home, the shock did not harm her. Tho police say it was an attempt at murder. Income Tax Further Ratified. HARRISBURG. Pa.. Feb. 1". The House passed today without a dissent Ins vote the joint resolution ratifying the income tax amendment to the Fed eral Constitution. The resolution will be sent to the Senate next week. State Department Urges All Xon Combatants to Keep Out of Dan ger Zone Emhassy at Mexico City Open to All Refugees. WASHINGTON. Feb. 12. Alarmed by reports from Ambassador Henry Lane Wilson that the combatants in Mexico City were training their guns in such a direction as to Increase the danger to Americans and other foreign resl dents, the State Department hurriedly dispatched instructions to Mr. Wilson i tonight to warn all non-combatants to keep out of the fighting zone. Mr. Wilson reported further that large numbers of Americans and other ; foreigners, terrorised by the rain of bullets In the residential section, had sought protection at the embassy and ! in that neighborhood of the city. The ' Ambassador said he found places of i refuge for hundreds. The department I emphasized to him the necessity of ! affording refugees every comfort and i protection within his power. Late developments in the situation were awaited tonight by Secretary Knox and other State Department offi cials at the Knox residence, where messages from Ambassador Wilson were received and answered. $500 will be allotted to the Mexican Red Cross Society for the relief of suf fering and distress incident to the revo lution in the capital. The remainder is to be expended by the Ambassador for the relief of sick, wounded and destitute Americans, Field Gnns neady at Vallejo. VALIaEJO, Cal., Feb. 12. Fourteen field guns and a large quantity of am munition and otner supplies are being held at Mare Island Navy-Yard for immediate shipment to ships bound for the Mexican coast. The shipment was prepared upon a telegraphic request from Reax-Admirai Sutherland, commander-in-chief of the Pacific fleet. It is probable the shipment will be made on the collier Justin, which is due here Sunday, Bed Cross Telegraphs $1000. WASHINGTON. Feb. 12. The Ameri can National Red Cross today tele graphed to the American Ambassador at Mexico. City J1000.
