The Supremo Court today In an opinion by Justice McBrldo reversed the case of the State against rTederick lladcr. and remanded It for a new trlsl. This case was appealed from Grant County, where the defendant was tried on a charge of arson. It being allefted he set fire, to two stacks of hay, the property of Km mett Barr. I'pon the trial, the prosecuting- wit ness. Barr. was asked what occurred oa hla place about July, 1906. and he an swered that Rader and another man lj the name of Plant rame throuKh tha place and went down by the hou.se and cut one of my milk eow'i tall off." Tho testimony brouKht out the fact that the defendant was arrested for this aliened offense and hound over, but the Krand Jury failed to return an Indictment aaralnst him. The court holds that the defendant. Indicted for burning a hay stack, could not be ex pected to come prepared to refute a rhino that he mutilated a cow several months previous.
