The lawyers refuse, however, to give any details as to the disposition of the estate, which Is estimated at $125,000,000. The Supreme Court today reversed and remanded the case of the Terwilliger Land Company versus the City of Portland and the llaaum Paving Com pany, in an opinion by Justice Bean, tnts case involving the validity of 13 paving contracts at a cost aggregating approximately ISU0.0U0. The court also today reversed and demanded the cause of the Board of Medical Examiners against William Klsen, appealed from Multnomah County. In an opinion by Justice Bnr nett the cause la sent back to the lower court. This was an action alleging malpractice of Eisen on the persui of Anna Foieen. and an attempt tof the board to revoke license of Eisen as a practicing physician. In the opion of the court today Elson wins the tlrst round in the highest tribunal of the state. In the case of Ben C. Ely versus Louis J. Wlide. which Involved a com mission for selling telephone company bonds and which is an echo of circum stances surrounding the case of V. Cooper Morris and th failure of the Oregon Trust Savings Bank, the lower court Is affirmed conditionally, the Supreme Court instructing Ely to. within 30 days, remit the amount In cluded In the finding as to the sale of bonds to the Scandinavian Bank of Portland. In the Terwilliger Land Company case against the City and the llassam Paving Company, Justice Bean states that he does not think as a matter of law that the city will not me required to pay a material portion of the amounts Involved In th contracts and thereby increase, the municipal taxes of the plaintiff, especially " In view of an allegation In the coniJalnt directly to the contrary. He declares that the demurrer to th complaint should be overruled and the Judgment of the lower court reversed and remanded fo such further proceedings as may be poper and not Inconsistent with the opinion. In the case of the Board of Medical Examiners versus William Klsen. Jus tice Bu.-nett declares that th complaint Is insufficient In point of law and that testimony of Dr. Hamilton as well as his writing Is inadmissible and for thnt reason the Judgment of the lower court Is reversed and remanded.
