No less than 20 letters, protesting against the pa a sage of this ordinance, has been received by Mayor Rushlight. Reversing a former decision which saved the notorious Flanders-street re sort of Frank Minto from forfeiture of license. Judne Taswell upheld yester day the right of the police to Induce sales of liquor by means of decoys, with a view to arresting the sellers. Hasel Graves, a young- divorcee, who It was charged, had attempted to set up a disorderly place In an exclusive resi dence district, was fined $100. Her at torney announced an appeal to test the ruling- of the court. When Minto's bartender was arrested for the second time In two weeks, for violations of the "model" ordinance, the contention was set up that the com mission of the crime had been Induced and that therefore the prosecuting witnesses were accomplices and barred from testifying, unless corroborated. Had a conviction been secured, the license of the saloon would have been forfeited automatically. neclslon Tied Police. The decision fell with paralysing force on policemen, wno asserted that their only means or catcning Diina pigs" was shut on". Immediately fol lowing the decision all plalnclothesmen were returned to uniformed duty and for a time there was no effort made to catch violators of the liquor ordinance. Attorneys for the city had been cauaht napping. but on further research, they found that the authori ties quoted against the use of decoys were from Colorado and were based on peculiar statute. The weight or au thority, they assert. Is on the other side. The question will be hard-fought n the Circuit Court, as on the ultimate decision depends the power of the police to obtain convictions except in tne rare cases where they may chance to see a sale not Induced by themselves. The woman on trial yesterday waa recently abandoned by her husband and established herself in quarters at Sixth and Jackson streets. In the midst of apartment-houses occupied by repu table families. Police Buy Liquor. Patrolmen Taft and Ackerman were taken to her flat, where a bottle of beer was sold to them for $1. Fred Moyer, superintendent of construction on the new Pantages Theater, who lives next door, also testified that he had bought liquor In the place after mid night. He was assured that he could have any kind of liquor he desired. Louis Penna. proprietor of a boarding-house, at 326 Front street, who Is aged and decrepit, was arrested two weeks before for selling liquor Sunday and was fined $100. The fine waa then suspended. He was arrested again last Sunday and held on two charges. The court again suspended sentence where the minimum penalty was $200, and ordered that he should pay the former One. WHEREJTO DINE.
