H. demons and wife against the Grays Harbor & PuKet Sound Railroad ap pellants, that Clemons Is entitled to ac tual damages but not to liquidated damages and orders that lower court, which awarded 14000 damages, grant a new trial. Clemons owns a logging road and no conceded the right to cross under his tracks on condition that the company pay him $1000 lor each day's delay in case of Interference.
