In Malheur County, is Involved In th suit of tha Willow River Land & Irrigation Company against th Eastern Oregon Land Company, which went to trial on Its merits before Federal Judge Wolver ton yesterday. The Willow River company Is seeking to condemn an ag gregate of (7.1 acres, mad up of a large number of strips, which it says It must have for constructing its ditches and flumes. The plaintiff al leges further that It has constructed three large reservoirs at great expense and that there Is enough water In th reservoirs to irrlgat the land suscep tible of Irrigation. Little of tha land wanted for flumes and ditches, says th plaintiff. Is fit for agricultural pur poses, because It Is to steep and rocky. Th Willow River company wishes to pay $1.26 an acre for the land. - Th Eastern Oregon Land Company, on the other hand, says It owns title to Willow Creek, a perennial stream which flows through Its land, and that It needs all th water of the stream for Its own Irrigation purposes, alleging that Its land would be worthless if It did not have th water. It says fur ther that It Is making surreys for th construction of reservoirs in which to store th waters of this creek and that of Burnt River, which It Is planned to convey to th reservoirs through what Is known as th El Dorado ditch. Th Willow River company. It alleges, has no light to us th water of Willow Creek, although It Is alleged It Intends to us It to Irrlgat land not adjacent thereto.
