CONVICT RESISTS REARREST Grand Jury Law Retroactive, Is Frank Wayne's Contention. An effort to quash the Information charging Frank Wayne in the Circuit Court with having participated in the robbery of a Qresham bank . in January, 1907, is being made by his attorney. John F. Logan, who has filed a demurrer. An effort was made to take the ques tion up before Presiding Judge Morrow yesterday morning, but the court con tinued the hearing until 2 o'clock this afternoon. It is the contention of At torney Logan that as the information was drawn by the District Attorney, and a statute passed by the last Oregon Leg islature re-established the grand jury system, the information is invalid. It was drawn, however, before the passage of the law. It is Attorney's Logan's con tention that the law is retroactive. Wayne was sentenced to a nine-year term on McNeils Island by Federal Judge Wolverton in June, 1907, for rob bing the Sellwood Postoffice. After ser ving three years he was released by the United States District Court of Ap peals in San Francisco on the ground that a sentence of three years for bur glary two for stealing money, two for stealing postage stamps, and a year each for receiving stolen stamps and money was illegal. He was re-arrested and brought back to Portland by Deputy Sheriff Beatty. Do Your Banking Where you are assured of absolute security and the most courteous service.
