The test suit instituted about thre years ago by the State Railway Com mission against the Northern Pacific, under the reciprocal demurrage law, re sulted In a decision here today in Su perior Court In favor of the company. While originally the suit waa expected to tept out the constitutionality of the law. today's decision is. of slight value in that It was based upon a showing that Bt the particular time the company was doing all In its power to handle the unexpected increased traffic, and that the company had made even greater preparations for thef expected increase than had most shippers. A peculiar feature of the hearing to day was that one of the witnesses called to testify in favor of the company's con tention was the original complainant, S. I. Somerville, of Napavlne. Director Newell's testimony before the ways and mean committee lias aroused indignation in this city. In a letter to the Chamber of Com merce a few days ago Senator Wesley 1. Jones said that Director Newell ex pressed great hope that the $30,000,000 issue would be passed. Men in the city characterize Director Newell's at titude yesterday as deplorable. They believe that he has allowed his per sonal enmity to Balllnger to overcome his best judgment. It was stated here tofore that as soon as any definite word Is received that the House will not pass the $30,000,000 certificate bill the High Line Association will Imme diately take steps to finance the Kitti tas irrigation project, for which the Itoclamation Service has promised to tloliver the water. CAPTAIN UNDER ARREST Vancouver Authorities Charge Xew Kra's Master With Manslaughter. VANCOUVER. B. C, March 31. (Spe cial.) Captain Cameron, .of the steamer New Era, has been arrested on a charge of manslaughter, the cause .being the mysterious death by drowning from his steamer of his engineer, on March 1. It had been supposed that the engi neer fell from the ship on a stormy night and drowned before his absence was noted, but the police now say they have reason to believe Captain Cam eron, who had been missing since the accident, struck the engineer a blow which caused him to fall overboard. The skipper was caught in North Van couver last night. INQUEST JUSTIFIES ESTES Jury Holds Sheepman Blameless for Killing Ttatmels. PR I NEVILLE, Or.. March 31. (Spe cial.) George Estes was exonerated from blame In having shot and killed H. C. Rannels by a Coroner's Jury to day. Testimony at the inquest snowed that Runnels had opened fire on Kstes from ambush, and that after shooting in effectually three times Rannels was shot and killed -by Estes. After brief deliberation by the jury a verdict of Justifiable homicide was re turned and Estes was discharged from custody. LIFE TERM FATE AT 26 Tacoma Judge Sentences ltobber Un der Habitual Criminal Act. TACOMA. March 31. Fred Wallace, nlins J. J. Colton, 26 years of age, was sentenced to prison for life by Judge Easterday today, under the habitual criminal act. Wallace was caught after robbing a drugstore, and is the .same man who several weeks ago was dissuaded from a holdup of a grocery store by the motherly talk of the grocer's wife. There are three other convictions of crime in his record. When sentenced today he said: "It's prety tough to think of spend ing all my life in prison. I am not a Jesse James or anything like that, but 1 know I have been bad. I have been in Jail most of the time since I left school, and have had only 16 months liberty In that time." LON"DON. March 31. The official oppo sition amendment to Premier Asquiths resolution on the veto power of the House, of .Lords was moved in the House of Commons today by Sir Robert Banna tyne Finlay. It declares in favor of a strong1 and efficient second chamber, expresses will ingness to consider proposals for the re form of the upper house, but declines to proceed with the government propos als, which would destroy the usefulness of any second chamber. Winston Spencer Churchill the Home Secretary, made an important contribu tion to the debate. He declared when the veto resolutions were disposed of they would advance with the budget, regardless of the consequences. Unless the House of Commons carried the budget, it was idle, he said, to look to the Kins or to the country to carry the veto bill, but he predicted that at the proper time and under the proper circumstames they would succeed in carrying both the veto and budget meas ures to the steps of the throne. Mr. Churchill closed with a. significant statement. "The time for action," he said, "has arrived. Since the Lords have used their veto to affront the preroga tive of the crown and have invaded the rights of the Commons, it has invaded necessary that the crown and the Com mons, acting together, should restore the balance of the constitution and restrict forever the veto power of the House of Lords." Premier Asqulth's guillotining motion, which is published tonight, provides that the committee stage of all three reso lutions shall be concluded on the night of April 14. WAR VETERAN SUES CITY Vancouver, Mayor and Commission er Parlies to Trespass Action. VANCOUVER,- Wash., March 31. (Special.) Michael Dampf hotfer. Sr., 95 years old, who fought through the Civil War by the side of his son, Mi chael, 65 years old, today filed suit against the city . of Vancouver, J. V. Klsgins, mayor, and T. J. O'Nell, street commissioner,, to secure a restraining order from Judge Mcllaster to keep the city from trespassing upon his property at Thirteenth and F streets. In the suit the plaintiff alleged that he had been in peaceful possession of the property for 50 years, and had fenced, occupied and cultivated it until March 2S, when the street commis sioner tore down 160 feet of fence to throw open to the public a street. The temporary injunction was granted. SURVEY IS COMMENCED First Stakes Driven for Albany-Lebanon-Sweet Home Line. ALBANY, Or., March 31. (Special.) Work has begun on the permanent survey far the Albany & Interurban line to Sweet Home by way of Lebanon and the valley of the South Santiam River. The first stake on the survey was driven yesterday afternoon at the intersection of Main street and Salem avenue, in this city, by Dr. V. H. Da vis, president of the Albany Commer cial Clvtj; J. S. Van Winkle, secretary of the V.-lub; Wallace R. Struble. man ager ot the clutu aoi J. M. Hawkins and P. A. Young, of the board of di rectors of the railroad company. It is planned to construct two elec tric lines to Sweet Home, one by way of Lebanon and the South Santiam Valley and the other by way of Brownsville and the Calapooia River Valley. The men interested in the company say they have the money in sight with which to build the linessso soon as-the surveys are completed and rights of way secured. Hugh G. Fisher, ex-County Surveyor, is chief engineer in charge of the sur vey for the proposed lines. John R. Penland, a recent graduate of the Uni versity of Oregon, and Deputy County Surveyor, will have charge of the sur veying crew, and one of his assistants will be Louis A. Pinkham, the famous tackle on the University of Oregon football team, who won National as well as Northwest recognition as a gridiron hero. BOWLING RECORD MADE LOS ANGELES MAX HIGH IX INDIVIDUAL SCORES. Kruse and Bishop, of Portland, Take Day's Honors for Two Men in San Kranciseo. SAN FRANCISCO. March 31 (Spe cial.) The fifth night's competition in the Western Bowling Congress being held in this city, resulted in the break ing of a world's record under the exist ing conditions in the individual tourna ment. S. A. Dysinger. of Los Angeles, set up the remarkable world's record of bowling 682 in the individual scores, over the six alleys, and D. J. Ruhstaller was second with 625. J. H. Barbour, of Portland, followed with 595: C. J. Kruse, of Portland. 583; -C. H. Ball, 571; 1 F. Bishop, 537, and M. C. Manamy, 523. In the two-men tournel the Portland team. Kruse and Bishop, carried off the day's honors, with a score of 1207, just 13 points behind the Los Angeles team, which leads with a score of 1220 set up Wednesday night. Ball and Bar bour, another Portland team, were sec ond in the night's highest point scores, with 1114. Ruhstaller and Manamy bowled 1035. The tournament will come to an end Friday night, with the close of the in dividual and two-men team competi tion. There will be a special match be tween all star five-men teams Saturday night and the Portland team, Van couver team and a umber of local teams are slated to take part in the bowling. The Jesse Moore team of this city won the championship of the West in the five-tournament with the high score of 27S5. The Eugenes, of this city, were second, with 2736, Spokane 2734, Yosemites 2717, and San Francisco 2708. Portland- finished in the ruck in this division, with a score of 2499. The score of the winning Jesse Moore team was the highest ever bowled at a Western Bowling Congress. A. J. The attendance at the annual Pacific Coast Conference of the Young Women's Christian Association was largely aug mented today by the arrival of delega tions from the University of California, which heads the list of college delega tions. The morning session was en tirely given over to business. In order that the delegates might visit the big trees in the afternoon. Puget Sound Xavlgator Dead. SEATTLE, March 31. Captain Wil liam H. Ellis, who had owned and com manded - many steamers on Puget Sound, died today, aged 62 years. He served in a California regiment during the Civil War. Supreme Court Receipts Increase. SALEil. Or., March 31. (Special.) Clerk Moreland, of the Supreme Court, today made his quarterly report to the Secretary of State. Census Supervisor Guy & Kelly today received a telegram from Washington notifying him his request for increases in pay for enumerators in tfils district had been granted. For enumerators in Tacoma and the larger towns of KeUx's district tho In crease will be from 24 to 3 cents per name. Fdr the rural localities in the district the increase is 50 cents and VI a day, dependent upon locality and con ditions. The appointments for Kelly's district has not yet been made, a fact which has occasioned considerable com ment.
