Detective Joe Day, who was sent to Philadelphia with requisition papers for the return of Samuel Levine, and Minnie Kwtcn, wanted in Portland; on the charge of stealing $aXH worth of jewelry, will arrive tonight from the Eastern city with only one of his prisoners. The woman es caped the meshes of the law because, it ifl said, the detective failed to present his case properly In the Philadelphia courts. The circumstances of this escape will prohably be made the object of rigid in vestigation by Chief of Police Cox. Re ports from Philadelphia convey the in formation that the woman was allowed to KO free with incriminating evidence in her possession, thus weakening the case In the Oregon courts and making successful prosecution of Ijevine doubtful. Allega tions mado in Philadelphia. Indicate that, although Detective Day had requisition papers in his possession signed by the Governors of Oregon and Pennsylvania, he failed to make this fact known to Magistrate Scott of the Central Police Vmrt. The magistrate thereupon dis missed the woman on the ground that sufficient facts had not been set before him to warrant her- retention. Philadelphia reports also have It that Magistrate Scott, after learning- that De tective Day had the requisition papers in his possession; denounced the case from the bench. David A. Pepp, of the firm of Gruber & Pepp, attorneys In the Board of Trade building, has been engaged to appear for Levine through an acquaint ance of the prisoner In this city. Chief of Police Cox knows little of the caee. Day telegraphed him after the prisoners had been arraigned. In the Phil adelphia Police Court that he was re turning with Levine only, because the court had taken the woman out of his hands, and that the evidence, he thought, was insufficient. Chief Cox at the time of the arrest of the pair by the Philadel phia police was informed that Levine and Minnie Kesten had been caught with the stolen jewelry in their possession. Chief Cox said yesterday if ho finds the woman was allowed to go with the jewelry in her possession ho will demand an inves tigation. Detective Day, a few years ago, lost a prisoner while en route to Portland. The prisoner was the son of a wealthy woman who was making strenuous eiioria 10 clear him of a charge of forgery. The ftory told was that Day went to Bleep and that the prisoners jumped from the train , hanadcuffed and shackled. Levine and Minnie Kesten were arrested in Philadelphia December 29. They had been posing there as man and wife. The complainant against them here is M. lllmmelfarb, of 6WHa First street. He and the accused pair had been good friends, Irvine and the woman having visited the Jlimmelfarhs frequently. It Is alleged that after learning that jewelry was se creted in the lllmmelfarb home, tney robbed the house in Himnielfarb's sence. ab- Oratorical Tryout Comes January 2 8 SAIiEM, Or., Jan. 17. (Special.) The preliminary oratorical meet for the state contest will be held in the chapel of Willamette University on January 28. Huth Rees, Marie Schmidt and Perry Relgclman are the local contestants. The state contest will be held in this city the latter part of March, and the Wil lamette, students are planning a rousing welcome to the representatives of tho various schools that will participate.
