LAWYER ANALYZES RULING presely prohibit the Legislature from conferring- the right of suffrage upon certain classes and does not mention women as on'e of those classes. In the light of the Cochran decision the con stitution says certain persons shall have the right to vote at all elections, and that the Legislature shall not con fer the right of suffrage on certain classes, and consequently It must be held that the Legislature has power to confer that privilege on all except the prohibited classes." Reasoning From Cochran Case, At torney Declares Since Law Is Not Prohibitive Fair Sex Has Chance at Ballot. SALEM, Or.. Dee. J7. (Special.) "The decision of the Supreme Court in the case of the State vs. Sam Cochran, I am firmly convinced, will result in giving the women of this state the right of suffrage," declared a promi nent attorney today. -'The court lays down the 'rule in the Cochran cane, that because the constitution does not expressly prohibit an increase in the number of Supreme Court Justices from three to five, or some other number, the Legislature has the constitutional author ity to pass an act authorizing the in crease. "Now, take section 2 of article 2 of the constitution of Oregon, dealing with the qualifications of electors. It says: 'In all elections not otherwise provided for by this constitution, every white male citizen of the United States of the age of 21 years and up wards who shall have resided in the state during the six months Immediate ly preceding such election; and every white male of foreign birth of the ago of 21 years and upward, who shall have resided in the United States one year, and shall have resided in this state during the six months imme diately preceding such election. and shall have declared his Intention to be come a citizen of the United States one year preceding such election, conform ably to the laws of the United States on the subject of naturalization, shall be entitled to vote at all elections au thorized by law." Women Not Barred. "An examination of the opinion of the court in the Cochran case shows that the construction of the constitu tion as applied there fits the section above quoted to a dot. And the appli cation is strengthened by section 3 of article I, which reads: 'No idiot or in sane person shall be entitled to the privileges of an ejoctor. and section 6, which says: 'No negro. Chinaman or mulatto shall have the right of suf frage.' "These sections say who shall vote, but as they do not specifically set forth who shall not vote, except as above noted, and it seems to me that under the construction placed upon the con stitution by the court in the Cochran case, women have a right to demand the ballot. In that case the court holds that an increase in the number of Jus tices of the Supreme Court, not being expressly prohibited, the Legislature had the right to pass a law Increasing the membership of the court. GRANTS PASS, Or., Dec. 25. (To the Editor.) An editorial In The Independent of New York, issue of December 16. makes an assertion which I should like to have explained through The Oregon Ian. The article mentioned, states: "The Nobel prize for chemistry goes worthily to Wilhelm Ostwald, of Leipzig Univer sity. . . . Matter is to him simply one of the factors of energy, like velocity. Formerly, he tried to dispense with the atomio theory, but now that anybody with a 50-cent spinthariscope can watch and count the individual atoms, he has come to admit their objective reality, as well as their undeniable convenience." Is it a matter of general knowledge that "individual atoms" have been seen and oounted, and where can one pur chase the spinthariscope for that pur pose? R. K. HACKETT. The Independent goes beyond the facts. Individual atoms cannot be seen and they can be enumerated only by mathematical devices. Heckbert, an attorney who lives at the Elton Court, this city, is a part owner In the schooner Davis Palmer, which is reported lost off the Massachusetts coast, with 11 drowned. Mr. Heckbert said last night the Davis Palmer was one of a fleet of several schooners engaged in the coal-carrying trade. , She had a capacity for 5000 tons of coal. She was built four years ago, at a cost of $150,000, Mr. Heckbert was more concerned last night at the news of loss of life on board than for the vessel herself. Auto mobile manufacturers have made a for mal protest against the advance on car load shipments of machines as - a result of the recent Increase from Eastern and Middle Western points to the Pacific Coast. They seek readjustment or post ponement of the date named for the In crease to go into effect until a confer ence can be had with the members of the transcontinental bureau. Rates on auto mobiles have been equalized by the trans continental freight bureau. The new tariff raises the former rate of $3.50 per 100 pounds to ti on carload shipments. On less than carload shipments the old rate of J7 still prevails. In raising the rate 60 cents, the ajl- roads, howerver. granted the requests of automobile men that the minimum be reduced from 12.000 to 10,000 pounds per car. where the car used is less than 42 feet long. CAR CHAINED, SUIT IS ON Pullman Company Asks Damages of Sheriff and Attorney. COLUMBUS, O., Dei 27. The Pullman Company today filed a suit in the United States Court againet Sheriff Linke. of Licking County, Attorney Fred, W. Black and Melville Gillette, of Newark, O., for $20,000 damages. The company asserts that on November 20, one of its' cars was taken out of a Baltimore & Ohio train bound for Wash ington, and chained to the tracks through the action of the defendants. " Mr. Gillette Is said to have taken the .Horses Killed by Train. ALBANY. Or., Dec. 27. (Special.) The northbound Albany-Springfield train ran into and killed two horses on the farm of L. T. Berry, just south of Plainview, this morning and passengers' on the train did not even notice a jar. There were -hree horses on the track and so thick was the action because he could not get payment for $120 worth of clothes he says had been stolen -or lost from one of the Pull man cars. The Sheriff served the attach ment and the passengers declared they had been subjected to great inconvenience.
