OFFSETS TO BE REJECTED Payments Can Be Made Only to Persons Themselves and Claims Against Government Can not Bo Assigned. OREGONIAN NEWS BUREAU. Wash, insrton, D. C, Dec. 17. Secretary Bal Hngror, following- out the recent ruling of the Controller of the Currency. Is making- arrangements to reimburse in cash all settlers who performed work on Federal irrigation projects, but who have not yet been compensated by the Government for their labor. The long pending controversy over the- redemp tion of water-users' certificates is about to be adjusted, without resort to fur tHer legislation. Every settler who per formed work or furnished materials, and who has been unable to procure a settlement of his account. ' will be recompensed, dollar for dollar, and that in the very near future. For the Di rector of the Reclamation Service has declared there is ample money in the reclamation fund to discharge this in debtedness. And. under the Controll er's decision, money from this fund will be used in settling these old ac counts. Obligations Are Valid. As heretofore stated in these dis patches, the Controller concurs in the view of Attorney-General "Wlckersham that there was no authority of law under which the co-operative plan of building Government projects could be adopted. Nevertheless, the Controller, when the full case was submitted to him by Secretary Balllnger, held that the obligations Incurred by the Gov ernment while the co-operative plan was in operation are valid obligations, having the full force and effect of contracts, and must therefore be dis charged. In matters of this character the say ot the Controller is final, and the plan outlined in his decision will be followed to the letter. The Controller, in his opinion, quotes the opinion of the Attorney-General, ind adds: "As I understand the purport of this opinion, it Is to the effect that the value of the work done under the void contract may be paid from the reclama tion fund to the persons who did the work; that the only purpose for which the certificates can be used is as evi dence of the amount of work performed and by whom: and that the certificates cannot be used by the original payee or transferee as a discharge pro tan to of his indebtedness: and that the Water Users Association cannot be recog nized as a joint participant in any way. Offsets Not Allowed. "The basic principle underlying the question submitted to this office is found In a suggestion by the Director of the Reclamation Kervice that the amount due to the Government from water users for water rights may be pet off against amounts due by the Gov ernment for labor and material fur nished as evidenced by the certificates Issued while the co-operative plan was . in force. "The Attorney-General, in his opinion of September 8, 1909, said: "'I find no authority "whatever under any statute for any officer to permit such a reduction as a set-off against an amount due the United States on account of the charges re ferred to." "This would seem to dispose of the question as to your right to set off the amount due from water right ap plicants asainst the amount due to tuc.h applicants. "I fully agree with the Attorney General that no officer of the Govern ment has a right to permit a reduction fts a set-off of the water-right charges made under the act of June 17, 1902, on Recount of any debt that may be due from the United States to such water- right applicant. "These charges not being a proper tubject matter of sot-off, it is not necessary to consider the question as to whether any officer other than the Secretary of the Treasury could make .or authorize such set-off or not." Money on Hand lo Pay. The Controller then quotes the Director of the Reclamation Service as having advised him that "there are suf ficient moneys in the reclamation fund from which cash payments can be made," and holds that moneys coining into the fund after the work was per formed by "settlers may he utilized in paying these iicc-mint. for the recla mation fund is a permanent fund, creat ed for a stated purpose, and the pay ment of settlers such as referred to comes within the scope of this fund. "While section 374 of the revised statutes requires that all contracts with the. Gov ernment shall be duly siKned by the head of a Government department and by the contracting party, the. courts have fre quentlv held that contracts not made in accordance with this provision of law, w hen once executed, are valid and binding uDon the Government." He therefore holds that there was' an implied contract on behalf of the Government to pay the laborers who performed the work and ac complished the reclamation works for which the certificates hi question wore issued the fair valuo of their services, and "in the absence of other and different evidence these certificates may be taken to measure the value of such services, and the persons who performed such service can be paid from money now In the rec lamation fund." Item bv Item, the Controller summarizes his opinion as follows: "Cash payments eQual to the value of th work dor.c or material furnished can be made to those who did the work or furnished the material. The certificates would be prima facie evidence ot the valuo of the work done or material fur nished. The fact that such holders of cer tificates may be Indebted for water rights does not in any way affect your light to make payments to them for the amount of work shown to hftve been furnished by them by fr-aid certificates. - Claims Cannot Be Assigned. "Claims against the United States can not be . assigned. Therefore cash pay ments cannot be made to those water rlfcht applicants who hold certificates rep resenting work furnished by other per sons under contract with the associa tion. "You can only make payments to per sons who did the work or paid others for doing It for them. You would hse no right to make a payment to the holder of a certificate as evidence of work done unless the holder thereof did the work or furnished the material, or paid some other for doing It for him. You should jav. the person, wlu did the, work, or procured it to be done, regardless of who now holds the certificate or who la liable for water rights. "It Is the duty of the reclamation serv ice to pay the persons who performed the service, or procured its performance, reeardless of who is now the holder of the certificates issued, and leave the parties to work out their equities and legal rights among themselves". The riKht of holders of certificates to payment arises not from the certificates but from the fact of performance of service and this claim cannot be transferred. HOMESTEADERS WILL MEET Affidavits on Siletz Situation to B " Prepared at Dallas. SALEM, Or.,-Dec 17. (Special.) The Siletz homesteaders will meet on De cember 29 to talk over their claims and present affidavits of the true condition of affairs In the Siletz. The affidavits and a report of the meeting will be sent to Senator Chamberlain and the other members of the Oregon delega tion at Washington. The date was fixed this afternoon at & conference between a committee from Dallas representing the homesteaders and Oswald West, who is acting for Senator Chamberlain. It Is -planned to have all the homesteaders present and to have each one armed with an affi davit setting forth the facts in his in dividual case. MEN'S TICKETS REFUSED Employment Agency Tangle Inter rupts Laborers' Trip South. OREGON CITY, Or.. Dec. 17 (Special.) Six laborers, bound for Weed, Cal., were put off the train at this city on Thursday morning, the transportation furnished them by an employment agency in Portland having been refused by the Southern Pacific Company. The men wore quartered for the night in the City Jail. Night Officer Shaw reported the case to Mayor Carll, who went to Portland to investigate, protesting against men being shipped from Portland and unloaded in this city. A large high-pressure area is central over the Northern Rocky Mountain States and the barometer Is relatively low over Cali fornia. This distribution of pressure has caused light northeasterly winds with con siderable cloudiness, but without any pre cipitation of consequence on the Faciflo Slope. Iight irnow has fallen In Western Montana where the temperatures range from 16 decrees above zero at Helena to S6 de grees above aero at Kalispell. The tem peratures over the North pacific States have remained nearly stationary, except in South eastern Idaho, where it is eight degrees cooler. The indications are for fair weather In tni district Saturday, except in Northwest ern Washington where cloudiness will in crease and probably be followed by rain. The temperatures will slowly rise.
