REPORTS AT 10 O'CLOCK Judge Gantenbein Announces That Sentence Will Be Passed Sat urday on Man Who Killed II. A. Garrett. R. T. Dickerson was convicted of man slaughter at 10 o'clock last night by the Jury In Judge Gantenbein's department of the Circuit Court which has been try ing him for the shooting on June 21 of H. A. Garrett, who, it was alleged, had won lire. Dlckerson's affections. The Jurymen Inserted In their verdict the words "no recommendation," show ing that there had been some talk of recommending the prisoner to the mercy of the court. Judge Gantenbein announced that he will sentence Dickerson at 9: A. JI. Saturday. The penalty for man slaughter Ifi from one to 15 years in the etate penitentiary. When the Jurors retired at 4:30 o'clock yesterday afternoon they stood seven for conviction of murder in the first degree, the penalty for which is hanging, and five for acquittal. The next ballot showed two voting for jruilty as charged, four for not guilty, three for second degree, which would bring life imprisonment, and three for manslaughter. Eleven ballots were cast, two standing out for second decree until the tenth. . Story of the Shooting. Garrett was in Dlckerson's employ as a teamster at the time he was shotT The murder took place on the Dickerson ranch, on the Patton road. Dickerson's wife had left him May 22. and he believed Garrett to have been responsible for her leaving. It was tneir second separation, a remarriage having taken place In tha February previous, after Mrs. Dickerson had secured a divorce. Dickerson appeared disappointed when the verdict was read last night. He evi dently expected acquittal. He paled a little as he stood while the verdict was being read. , Attorney Seneca Fouts finished his ar gument in Dlckerson's behalf yesterday morning, being followed by Attorney John A. Jeffrey, also for Dickerson. The letter's argument closed at noon, when Deputy District Attorney Fitzgerald opened Are for the state, and poured upon the heads of Dickerson and his counsel a scathing denunciation for the methods he said had been employed in the defense of the case. He declared that this case had been "pettifogged through the court." t.lat the defense was "hatched out" .in the minds of the attorneys who were opposing him. "1 knew a man once who was so full of water that all he had to do was to stoop over and it would run out." said Deputy Fitzgerald. "I think my friend Fouts is In that condition, for In every case I have ever seen him try he has shed tears that way. Shot in Broad Daylight. "When a man goos out in broad day light and shoots his victim down like a dog he has to get his lawyer to concoct some sort of a defense for him. If there ever were-any criminal relations between Mrs. Dickerson and this poor devil Gar rett, Dickerson never knew anything about it except by idle rumors. Gen tlemen. Dickerson never saw those let ters written to Garrett by Mrii Dicker son until after the murder was com mitted. "They oueht to be ashamed of them selves, for they even went to the extent, after they had tilled this poor fellow Garrett, of damning him: of telling jrou, gentlemen, that they believe his soul Is now in hell. That's a great way td defend a murder case. Even a man like this fel low Dickerson. with the Wood of his fel lowman on his hands. I would not like to see in the lower regions. It is not a thing to gloat over." As Mr. Fitzgerald reached this point In his argument a lively tune by a band floated in at the open windows, and broke the tension In the courtroom with a ripple of laughter. Mr. Fitzgerald paused, and was about to read Dickerson's answer to his wife's last divorce suit, when he looked around at the crowded courtroom and the women present who were straining their ears to catch every word, and remarked that "women ought not to attend cases of this kind." Then he refrained from reading the answer. Says He Is Gun Man. "This man has such a mind that at every idle rumor he hears he is driven to a thirst for human blood." said Mr. Fitz gerald. "A gun went off .In the Dicker snn house once before, and Dickerson tells you it was only an accident. It was no such thing, gentlemen: he was a tun man, and always had one at his hand. Mrs. Dickerson made a great mis take when she married him the second time." In hi? argument for the defense. Attorney Jeffrey said that he believes there is a mysterious law which decrees that every man shall be punished at some time and In some manner for the wrong that he has done. "I do not think you men will declare by your verdict," he continued, "that the seducer of women and smasher of homes can ply his wicked vocation unrebuked right here In Portland.' M. Wagner and J. R. Ewlng. MAYOR AFTER PARK LAND He Orders Kavanaugh to Sue for Mount Tabor Sites. Mayor Simon yesterday directed City Attorney Kavanaugh to start condemna tion proceedings against a number of property-owners on Mount Tabor. The property in question is that desired by the city for the hew Mount Tabor Park. Early In the afternoon Mayor -Simon looked over the property and interviewed a number of the property holders who accepted the terms offered by the city or offered terms acceptable to the city. But there were" a number who held out for prices which Mayor Simon considered extortionate. Against these condemna tion proceedings will be started at once. FREE BUREAU TO MOVE Mayor Seeks New Site for City's Em ployment Office. The Free Employment Bureau is to be moved cut of tht City Hall as soon as desirable quarters can be found by Mayor Simon. The Mayor stated yesterday that the two rooms occupied by the Free EmV ployment, Bureau are badly needed by the Water Department, which is at present badly cramped for quarters.
