Declar ing that the rate fixed by the Inter state Commerce Commission on lumber shipped from the Willamette Valley to San Francisco Bay points Is confisca tory, and attacking the constitutional ity of tha act creating the commission, attorneys representing the Southern Pacific and the Oregon & California Railroads today filed in the United Ftate Circuit Court of Appeals a new bill of complaint, containing allega tions omitted in the previous proceed ings which ended yesterday In a de cision upholding the demurrer of the . Government. In the original application for an Injunction, the transportation com panies rested their case upon the con tention that the Commission was not vested with the power of fixing or altering freight rates, and besought the court to- review. the findings of the Commission. This afternoon the Federal attorneys filed with the court a demurrer to the amended complaint, basing their objec tion to the granting of an injunction on the same grounds as set forth In tha previous case: That the complaint does not show sufficient cause for ac tion. The case was then argued until the close of the session and will be re sumed tomorrow. One of the features of the amended complaint Is the declaration that the Interstate Com merce Commission, In fixing the rate against which the railroads are fight ing, not only exceeded Its authority, but set the new rate at(an unjust and unreasonable figure, basing such rate on tha cost of water transporta tion rather than railroad hauling. FIGHT MADE BT II RAILROADS Ask Injunction of Enforcement of Louer Rates on Cattle. ST. LOUIS. Oct L Tha Missouri, Kan sas Texas and 56 other Western and Southwestern railroads have filed a suit In tha United States Circuit Court here asking that tha Interstate Commerce Commission be temporarily restrained from enforcing an order effective Oc tober 15 lowering the rates on cattle shipments from Texas. New Mexico, Oklahoma and Kansas to Chicago, St. Louis. Kansas City, Omaha, St. Joseph and New Orleans. Tha railroads also ask that the rate on ranga cattle from the Southwestern state named and Colorado. Utah, Wyoming and Montana be enjoined. The railroads allege that the new rates are confis catory and that under them they will loss mora than tl.CO0.00o a year. IXMBKRMEJT ARE SATISFIED Decision Disposes of Attack on Con stitutionality of Commission. "The decision Just rendered knocks out the contentions of the railroad attorneys that the body was unconstitutional because it exercised leg islative. Judicial and executive functions and was. therefore, not in accord with the Constitution of the United States. The decision sustains the reduction ef the rate on rough lumber from Port land and the Willamette Valley to Cal ifornia points from ti to $3.40 and $3.65. depending on the point at which the shipment originates. As 1 understand It. these rates will become effective Oc tober la snd. although I think the rail roads will tight the decision further, I doubt if It will avail them." WENATCHEE GROWERS SELL Clou Sale for 150 Cars of Fruit to Eastern Buyers. SPOKANE, Wash., Oct. L (Special.) Tha deadlock which has existed between tha buyers and the Fruitgrowers' Associa tion In Chelan County haa been broken and toe association has closed a deal for the sale of ISO cars of fruit to an East ern firm with the condition that the num ber may be Increased to SO cars, accord ing to a Wenatchee dispatch to tha epokesman-Revlew. The price received and tha names of the purchasers will be announced later. Tha buyers had combined against the growers with the result that not much fruit was moving, but the sale of today relieves tha situation and the disagreeable featura of the season la eliminated.
