Because the judpeand both opposing lawyers wanted to go fishing:, there was some trouble in fixing- the date for the hearing of a railroad case in the Federal Court yesterday. The suit was that brought by the 0. R. & N. to nullify the reductions In distributive rates out of Portland to Eastern Ore . gon territory east f The Dalles, on the ground that the State Railroad Commission would thereby be regulat ing interstate commerce. TV. W. Cot ton, attorney for the O. R. & N., who appeared with H. F. Connor to secure an injunction against the Commission restraining It from putting the reduc tions Into effect, wanted the case tried at once. J. N. Teal, who appeared with Attorney-General Crawford for the Commission to defend the rate reduc tions, wanted the hearing postponed until Summer. ,4The reason Mr. Teal wants this case postponed is so that he can go fishing," declared Mr. Cotton, "He knows very we'! that he intends going away for a fishing trip next week and that Is the only reason he wants the hearing de ferred. . As to the statements he asks for, we are prepared to submit ttaem at any time. Now, I want to go fishing myself sometime this Rummer and I do not want to bo 'detained here by this cast." "I want to go fishing myself Jn August." said Judge Wolverton. "I wish your honor were going with me next week, for I am going to a good place," said Mr. Teal. The date for the hearing on the in junction was set for July 6, and the "court granted a temporary restrain ing order until the case Is threshed out nn Its merits. This was to relieve Mr. Cotton, who said that during the past week there have been 1300 violations f the Commission's rate order for which his company might be fined $10,000 for each offense. He contended, however, that if such a penalty were Imposed the act would be plainly un constitutional on the ground that the maximum fine cannot be levied in such a situation. The reduced rates ordered by the Commission were to go Into effect on May 13. Suit was filed by Mr. Cotton on May 12 to enjoin the reductions from becoming effective, on the ground that the order effects interstate com merce and tho Commission Is, there fore, exceeding its authority. The foimer rates out of Portland to the Eastern Oregon territory were said to be discriminatory. Mr. Cotton said yesterday that the reductions are confiscatory. Then it was that the minds of both judge and counsel turned to matters piscatory and the time of taking the season's fishing trips came up. Mr. Teal said time is needed to give the railroad opportunity to submit proof that the reductions are confis catory, but Mr. Cotton said he has pre pared statements showing this. The matter will be threshed out at length in the Federal Court in July and an Interesting suit, involving Important questions and even the authority of the Commission is promised. - Big Percentage of Failures. PENDLETON, Or., May 26. (Special.) Of 98 eighth grade pupils In the public schools of the county, outside of Pendle ton, taking the recent final examinations, only B2 passed.
